Serial No. C-56447 <br />(REVISED 3-9-95) <br />' CONTROLLED SURFACE USE STIPULATION • <br />MODERATE GEOLOGIC HAZARDS <br />Surface occupancy or use is subject to the following special operating <br />constraints. <br />Special interdisciplinary team analysis and mitigation plans detailing <br />construction and mitigation techniques will be required on areas having <br />moderate geologic hazards. (The interdisciplinary team could include: <br />geotechnical engineer, soils engineer, roads engineer, coal mining engineer <br />and reclamation specialist.) Attributes constituting moderate geologic <br />hazard include stabilized earthflows, stabilized mudflows, stabilized <br />landslides; slopes adjacent to failed slopes or active earthflows, <br />mudflows, or landslides and avalanche chutes; areas of rockfalls and flash <br />flood areas. <br />On lands described below: <br />All or portions of Sec. 14, 22, 23, 26, T135, R90W, 6th PM with moderate <br />geologic hazards as generally delineated on the attached map dated on <br />3-8-95. The map is for planning purposes only. The application of the <br />definition of moderate geologic hazard to ground conditions will determine <br />whether the stipulation applies. In the event of any conflict between <br />written clauses of this stipulation and the map, the stipulation clauses <br />shall control. All National Forest System Land within the leasehold whit <br />is classified as having moderate geologic hazards falls under jurisdicti~ <br />of this stipulation. <br />For the purpose of: <br />To insure the stability of _'acili=ies required (such as roads, waterlines, <br />water tanks, powetlines, ventilation shafts, ancillary buildings, <br />drillpads, etc.) during the coal mining operations and to insure the <br />stability of lands adjacent .o these facilities. <br />It may become necessary for a waiver, exception or modification (WEM) to <br />this stipulation for the operator/lessee to use the surface in the area <br />covered by this stipulation to allow for the recovery of the coal reserve. <br />WEM's to this stipulation will be considered only at the time operations <br />are proposed, and will be subject to the Forest Land and Resource <br />Management Plan in effect at the time of consideration, and will be subject <br />to applicable regulatory and environmental compliance requirements. <br />Granting of a WEM is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service reserves the <br />right to impose other scipulat'_ons in the same area of this leasehold if a <br />WEM is granted. <br />Any changes to this stipulation will be made in accordance with the Land use <br />plan and/or the regulatory provisions for such changes.
