EFCI had left several established trees on the Pond 3 embankment. These trees had volunteered on the <br />pond embankment and after grading they stood several feet above the surrounding topography. In <br />response to specific direction from Ms. Saunders at the recorded informal conference on 15 January <br />2003, EFCI removed the `tree islands' at Pond 3. On 24 January 2003 the Division confirmed the trees <br />had been removed. <br />In response to Ms. Saunders concern about the portal vent pipe, EFCI capped the pipe. EFCI also <br />removed the PVC pipe at the former outlet of Pond 3. <br />In response to Ms. Saunders concern regarding landowner notification, the Division explained the <br />revision process in Rule 2.08.4(6) during the 5 November inspection and in a letter dated 24 December <br />2002. This rule requires that notices of completeness and proposed decisions for technical revisions to <br />the permit be published in the local paper and allow fora 10-day public comment period. All such <br />publications occurred. Ms. Saunders and the Division have communicated many times during the <br />vazious phases of the operation. EFCI has provided a111ega1 right to enter documents, including a copy <br />of the Vento lease between EFCI and the Vento property owners dated Mazch 20, 2000. EFCI is in <br />compliance with the right to enter requirements of Rule 2.03.6. <br />Ms. Saunders 10 December letter was addressed to EFCI and copied to the Division. Ms. Saunders <br />requested either a key to the lab building or that the building be moved. Ms. Saunders also requested <br />the removal of al] heavy equipment, repair of a fence and the removal of heavy cable on the Vento <br />property. With the exception of the cable removal, the issues were beyond the scope of the approved <br />reclamation plan. EFCI removed the heavy cable. Additionally, EFCI has submitted a revision to <br />move the lab building off of the Vento property. <br />The Division responded in writing to Ms. Saunders letters on 24 December 2002. <br />A letter dated 15 November 2002 was received from Paula Coulter, on behalf of Irene Vento Coulter, <br />owner of 2/3 of the Vento property. Ms. Coulter requested a copy of the MSHA report detailing the <br />mine entry closure, fan shut down and any subsequent inspections including mine water pumping.
