IV. PROPOSED DECISION <br />Based on the observations and findings above, the Division proposes to approve EFCI's request for a <br />Bond Reduction and Phase I Bond Release for the Southfield Mine. This proposed decision will <br />release the applicant from liability for backfilling, grading and drainage control/reestablishment on the <br />68.6 acres included in the proposed bond release area. This includes the portal and facilities area, the <br />coal stockpile area, Ponds 1 and 2 basins (including the "bone yazd"), the explosives bunker area, the <br />Newlin Creek topsoil stockpile, the roadside topsoil stockpile azea, the borrow area, topsoil stockpile <br />area and subsoil stockpile area, the rock dust storage tank, the Pond 3 area, the south fan area and the <br />refuse pile. <br />The Division also proposes to approve the bond reduction requested by EFCI. The bond reduction is <br />for $14,072.00. <br />The Division currently holds a performance bond of $914,443.00 for the Southfield Mine in the form <br />of corporate surety 16-66-96 from National Union Fire Insurance Company. The Division proposes to <br />release a total of $534,012.00 ($14,072.00 for the bond reduction and $519,940.00 for the bond <br />release). The remaining bond to be held by the Division will be $380,431.00. The estimated cost to <br />complete the reclamation at the Southfield Mine is $223,856.00 (see Exhibit P). The Division will, <br />therefore, hold enough bond monies to complete the required reclamation, if necessary. <br />Any person with a valid legal interest who might be adversely affected by this proposed decision may <br />request a formal public heazing before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Public notice of this proposed decision will be published two times in The Canon City Daily <br />Record. Requests for a public heazing must be submitted to the Division in writing within thirty (30) <br />days of the first publication in The Canon City Daily Record.
