The Division finds that drainage control at the refuse pile is in compliance with the approved plan. <br />Magpie Creek Permanent Diversion: Magpie Creek is an ephemeral channel draining at least one <br />square mile. Magpie Creek was originally diverted from its natural path that previously passed through <br />the portal and facilities areas, to its current configuration by the prior Operator, Dorchester Coal <br />Company. The creek was diverted to keep upland runoff water from entering the portals and facilities <br />areas. The creek was diverted around the portal and facilities areas to the south, in its current <br />alignment. <br />With the approval of Technical Revision 15 (approved on 1 December 1993), the Division granted <br />approval for the Magpie Creek permanent diversion. The Division reviewed engineering plans and <br />hydrologic calculations and determined that the diversion met the requirements of Rules 4.05.4 and <br />4.05.18. <br />EFCI submitted Technical Revision 32 (approved 26 November 2001) to address design changes for <br />the final, post-reclamation design of the Magpie Creek permanent diversion. The final design <br />contained two parts. The first part of the design called for the slope of the diversion to be reduced to <br />0.5% with rock check dams to be placed in the channel intermittently to maintain the 0.5% slope and to <br />dissipate energy. This portion of the channel was to be grass lined and was seeded with several species <br />of native grasses that are tall and sod-forming to help with energy dissipation and overall channel <br />stability. The second part of the design called for riprap armoring of the lower, steeper portion of the <br />channel. The slopes on this steeper portion vary from 2%-10%. EFCI used 15-18" (Dso) riprap in a <br />section about 600 feet long. This section is at the lower portion of the permanent diversion and drains <br />into a lazge culvert that runs under the GEC road. <br />The Division has inspected the Magpie Creek permanent diversion on monthly inspections. On 5 <br />December 2002, the Division surveyed the diversion gradient and found that the diversion is <br />constructed as designed.
