azeas while inspecting the site on 13 November 2002 <br />Borrow Area, Topsoil Stockpile and Subsoil Stockpile: The borrow area, permitted to provide cover <br />material for the refuse pile, is located to the west of the refuse pile, between the refuse pile and the <br />topsoil and subsoil stockpiles. It was permitted with the approval of Technical Revision 20 (approved <br />on 22 September 1995). The Division permitted a maximum disturbance of 3.9 acres and the <br />maximum permitted volume of soil to be removed was 45,800 cubic yards. On S December 2002, the <br />Division surveyed the borrow area and determined that the disturbed area was 2.8 acres. Based on the <br />Division's survey of the borrow azea and the premining and postmining topography, the Division <br />estimates that approximately 23,000 cubic yards of material were removed from the borrow azea. In <br />the approved permit, EFCI estimated that they would need to excavate 5.1 feet over the entire borrow <br />area to get the necessary amount of cover. Comparisons of the premining and postmining topographies <br />show an approximate five-foot difference in elevation. This was verified when the Division surveyed <br />the area on 5 December 2002. The borrow azea was regraded and topsoil was replaced to create gently <br />sloping sides that approximate the topography of the surrounding area and provide positive drainage. <br />The regrading of the borrow azea is in compliance with the approved permit. <br />The topsoil and subsoil stockpiles were located on the northwest comer of the refuse pile and borrow <br />area. These were constructed as part of the initial excavation and construction of the refuse pile. The <br />piles were constructed on grade to maximize their stability, as the azea was a relatively flat area. All of <br />the subsoil stockpile was used for base cover on the refuse pile. The topsoil stockpile was used for <br />final cover for the refuse pile, Pond 3, and the rock dust tank pad. A small amount of topsoil, <br />approximately 500 cubic yazds, remains to cover Pond 4 after it is regraded. The azea of the subsoil <br />stockpile has been regraded into the borrow area and conforms with the approved postmining <br />topography. The topsoil stockpile will remain as a stockpile until it is used for final Pond 4 <br />reclamation (after approval of a Phase II Bond Release for the refuse pile and surrounding area). See <br />Exhibit I for pictures of the area. <br />Rock Dust Storage Tank: The rock dust storage tank and pad were located west of the refuse pile <br />across the fence that is the property line between the Vento Group property and the Cribbs-Jackson <br />property.
