borrow area and Ponds 3 and 4, the extent of the borrow azea and the 100-yeaz ditch around the refuse <br />pile. <br />The Division responded to Ms. Coulter's letter in writing on 24 December 2002. <br />Copies of all written correspondence were provided to EFCI. On 15 November 2002, EFCI sent the <br />Division a copy of the Coal Mining Lease between K2T, LLC and other property owners. The <br />Division was also copied on a letter EFCI sent to Linda Saunders on 23 December 2002. EFCI <br />provided comments on the concerns Ms. Saunders raised in her 9 November, 14 November and 10 <br />December 20021etters. <br />In Ms. Coulter's 15 November 20021etter she requested an informal conference as allowed for in Rule <br />3.03.2(4). Notice of the conference was sent to EFCI and all landowners that had submitted <br />correspondence and participated in the inspections. Notice of the informal conference was also <br />published in the Rocky Mountain News on 26 December 2002. <br />The conference was held on 15 January 2003 at the Division's office in Denver. An electronic record <br />was made of the conference, and a copy of the tape was made available to the participants. Participants <br />at the conference included representatives of EFCI, Montgomery Watson Hazza (EFCI's consultant), <br />the Corley Company, Ms. Linda Saunders, Ms. Paula Coulter, Ms. Irene Coulter and representatives of <br />the Division. All issues identified in the correspondence and during the inspections were discussed at <br />the informal conference. <br />The Division has considered all comments presented in the correspondence, during inspections and at <br />the informal conference in the prepazation of this Findings documents. The Division's observations <br />and findings of compliance are detailed in Section III, Observations and Findings. <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />Rule 3.03.1(2)(a) states that "Up to sixty percent of the applicable bond amount shall be released when <br />the permittee successfully completes backfilling, regrading and drainage control in accordance with the <br />Southfield Mine Permit No. C-1981-014 <br />SL-2 Findings 10 25 April 2003 <br />
