<br />Explanation of Findings
<br />Pursuant to Rule 2.07,6(2) of the Regulations of the Colorado Mined Land
<br />Reclamation Board for Coal Mining, and the approved state program, the Mined
<br />Land Reclamation Division or the Board must make specific written findings
<br />prior to issuance, reissuance or substantial modification of a permit. These
<br />findings are based on information made available to the Division that
<br />demonstrates that the applicant will be able to continue to operate in
<br />compliance with Colorado Surface Coal Mining Reclr.rnation Act, C,R.S., as
<br />amended, 34-33-101 et seq., and the Regulations ;~~oir~ulgated pursuant to the
<br />Act,
<br />This findings document is organized according to t{ie major disciplines
<br />reviewed during the repermitting process, The e~riti.en findings which must be
<br />made by the Division are addressed under the ap{~ropriate discipline
<br />sub-title. Additionally, any specific approvals required to be made by the
<br />Division pursuant to Rule 2.07,6(2)(m), ;:.c discussed under the appropriate
<br />discipline.

<br />Since original permit issuance; file princ•ip~": sh:rcl~older has chanced from
<br />Gulf Oil Corporation to Chevro^ U.S.A., Inc.
<br />Within the permit area, the surface ownershi;~ h.. bean severed from the
<br />private mineral estate in two instances, Pi~:tsl~i!i•c; and Midway has provided
<br />copies of the Edith E. Long, et.al, lease (V,~luo,e ~; Section 3.7, panes 3.7-17
<br />to 3.17-17h) and the Andrew Maneotes lease (Volume :', Section 3. 7, panes
<br />3.7-21 to 3.7-23) expressly granting the rio:,t in .;;tract coal by Gulf Oil
<br />Corporation and/or its successors (ie. Chevs~ur~ II,S.l,., Inc.).
<br />Based on information submitted by the applicant, '~i~c. Division finds that
<br />Pittsburg and Midway does not own or control any c,,~c:rations which are
<br />currently in violation of any 1ar~, rulr n. regul;.';:~ of the United States, or
