f <br />Section IV -Permit Variances <br />The Division has approved a variance from meeting approximate original contour for reclaimed <br />areas. The variance was approved following a demonstration that the requirements of Rule 2.06.4 <br />and 2.06.5 had been met, pursuant to Rule 4.27.3. In addition, the Division found that the <br />applicant had demonstrated that requirements of Rule 4.27.4 would be met. Information upon <br />which these findings were based can be found on pages 3-2 through 3-5 of the permit application. <br />The landowner request from the Bureau of Land Management (BLM), pursuant to Rules <br />4.27.4(4) and 2.06.5(2)(e), is included in Appendix K, of Volume ]V, of the permit application. <br />The lower portion of the disturbed area will be returned to AOC, but the mine bench area was <br />granted the limited variance, to allow for backfitled slopes of lesser steepness, which would meet <br />applicable stability criteria and support the approved post-mine land use. The mine highwall will <br />be completely backfilled, with the natural sandstone outcrop which forms a near vertical face <br />above the portals to remain undisturbed. <br />Section V -Decision to Require Revision <br />The following items pertain to various portions of the McClane Canyon Mine permit which need <br />to be resolved and/or need to be updated to reflect the current status and condition of the site. <br />The operator is requested to submit a technical revision application addressing all of the <br />items below, no later than April 15, 1999. <br />The operator is requested to provide the information originally requested in the DMG <br />letter of August 25, 1998 (enclosed) in order to allow us to finalize McClane MR-26 (and <br />also Munger MR-15). <br />2. Maps 2,2-2 (Surface Facilities) and 2.2-3 (Surface Water Control Systems) depict a "Rip- <br />rap Stockpile", located to the west of the topsoil stockpile. This riprap stockpile was <br />approved via a minor revision during a previous permit term. In actual practice, two <br />separate stockpiles developed in this location, a riprap pile and a pile of soil size <br />"construction material" generated from road ditch, sump, and culvert maintenance. <br />Appropriate sections of the permit application, including the Surface Facilities Map, and <br />narrative on page 2-34, should be amended to address the existence of the construction <br />material stockpile. Information should be provided on maximum volume, stabilization <br />measures, and use of the material during operations and final reclamation. <br />Certain information related to the recent change in operator contact person, and the fact <br />that the operator contact is no longer stationed at the mine site needs to be provided. <br />Official notification of the change in permitting and inspection contact needs to be <br />provided, with current address and phone number.
