On August 20, 2002, the Division received notice from the BLM that Kerr Coal Company had <br />requested total lease relinquishment. At that point, Kerr Coal Company acknowledged that no <br />further operations or development of the lease area would occur. <br />Since the permit renewal of January 11, 2002 there have been no Notices of Violation issued. <br />SECTION II -REVISIONS TO THE PERMIT <br />This section lists revisions to the permit since the last renewal, January 11, 2002. Since the last <br />permit renewal there has been no increase in bond amount required as a result of revisions to the <br />permit. <br />Minor Revision No. 37 was submitted on October 10, 2002 and a decision to approve the <br />revision was made on January 13, 2003. This revision provided an upgraded plan for sealing <br />exploration holes located in the North Lease Area. <br />Technical Revision No. 21 was submitted on September 24, 2001. The revision application was <br />deemed incomplete on October O5, 2001. Kerr has not responded to the Division's <br />incompleteness letter and the Division has not reviewed the application for adequacy. <br />The Division received an application for a Phase I Bond Release for the Marr Pit (SL-03). This <br />application was received on May 17, 2001. There aze no bond monies associated with this bond <br />release application, only release from liability for backfilling and grading and drainage <br />reestablishment activities. On February Ol, 2002, the Division approved Ken's request for a <br />Phase I Bond Release for Ure Marr Pit azea. Based upon review of the mine permit and approved <br />reclamation plan, the bond release application and the site inspection, the Division found that <br />Kerr had successfully completed backflling, grading and drainage controUreestablishmenY for <br />the Marr Pit area. This decision released the applicant from liability for backfilling, grading, and <br />drainage controUreestablishment on the 96.5 acres included in the Marc Pit area. <br />SECTION III -STATUS OF STIPULATIONS <br />One active stipulation listed below exists for the Marc Mine permit. <br />STIPULATION NO.2 -ANNUAL HYDROLOGIC MONITORING REPORT. <br />STATUS: Kerr Coal Company is required to submit an Annual Hydrology Report by <br />November 1 of each calendar year. This stipulation has and continues to be complied with. <br />On Januazy 11, 2002 (at the time of the last renewal) one stipulation was attached to permitting <br />decisions as follows. <br />STIPULATION NO. 23 <br />THE OPERATOR IS REQUIRED TO SUBMIT A PLAN FOR THE ABANDONMENT OF <br />ALL WELLS LOCATED ON BLM PROPRERTY NO LATER THAN JANUARY 25, 2002. <br />4 <br />
