Midterm Review <br />Marr Mine <br />C-1980-006 <br />This document presents the results of the Midterm Review of the Kerr Coal Company's (Ken) <br />Marr Strip Mine, conducted by the Colorado Division of Minerals and Geology (Division). This <br />Midterm Review was conducted to fulfill the requirements of the Colorado Surface Coal Mining <br />Reclamation Act, and Rules 2.08.3, 2.06.2 (10), 2.06.3 (4), 2.06.5 (2), and 3.02(4) of the Rules <br />and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, prior to its <br />midterm. Based on this review, for good cause shown, the Division may require reasonable <br />revisions or modifications of the permit provisions to ensure compliance with the Act and the <br />Regulation. <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, mountaintop removal <br />vaziances, variances from approximate original contour (AOC), and vaziances from <br />contemporaneous reclamation, respectively, be reviewed by the Division where applicable <br />during the Midterm Review. <br />The Marr Strip Mine does not conduct experimental practices, nor have variances been granted <br />for mountaintop removal, approximate original contour or contemporaneous reclamation. <br />Rule 3.02.2 (4) requires that the Division review the amount of performance bond liability and <br />the terms of acceptance of the bond every 2-'/z years. <br />This Midterm Review consists of a review of the Man Strip Mine permit application and <br />previous Findings Documents to identify items that may have been overlooked during the initial <br />review.-The Division also reviewed all subsequent revisions and stipulation responses to ensure <br />that all permit conunitments and conditions were being followed. Problems and observations <br />from past Division inspection reports were also considered. <br />SECTION I -HISTORY OF SITE <br />Ken Coal Company opened the Marr Strip Mine in 1974. The mine is located ten miles east of <br />Walden, Colorado in Jackson County. The mine lies west and southwest of the Canadian River <br />on the east side of North Park, with a permit azea covering approximately 1600 acres. The Kerr <br />loadout facility is south of Walden. <br />Ken Coal Company submitted Permit application C-80-006 to the Colorado Mined Land <br />Reclamation Division for mining at the Marr Strip Mine on July 30, 1980. The permit was <br />issued on Mazch 20, 1981 with twelve stipulations. The permit has been renewed every five <br />years since then with the most recent renewal having been issued on January 11, 2002. This is <br />the fifth nud-term review of Permit C-80-006. <br />
