II. SUMMARY OF REVISIONS AND STIPULATIONS <br /> Stipulations <br /> No stipulations were attached to the renewal permit dated November <br /> 7, 1994. The following stipulations were attached to revision <br /> approvals subsequent to permit renewal. <br /> Stipulation No. 50 (TR-38) <br /> IF, IN ITS OPERATION, THE OPERATOR DISCOVERS ANY CULTURAL REMAINS, <br /> MONUMENTS OR SITES, OR ANY OBJECT OF ANTIQUITY SUBJECT TO THE <br /> ANTIQUITIES ACT OF JUNE 8, 1906 (34 STAT. 225; 16JU.S.C. SECS. 431- <br /> 433) , THE ARCHAEOLOGICAL RESOURCES PROTECTION ACT OF 1979 (PUBLIC <br /> LAW 96-95) , AND 43 CFR, PART 3, THE OPERATOR SHALL IMMEDIATELY <br /> CEASE ACTIVITY AND REPORT DIRECTLY TO THE AREA MANAGER, BUREAU OF <br /> LAND MANAGEMENT. THE BUREAU SHALL THEN TAKE SUCH ACTION AS <br /> REQUIRED UNDER THE ACTS AND REGULATIONS THEREUNDER. THE OPERATOR. <br /> SHALL FOLLOW THE MITIGATION REQUIREMENTS SET FORTH BY BLM <br /> CONCERNING PROTECTION, PRESERVATION, OR DISPOSITION OF ANY SITES OR <br /> MATERIAL DISCOVERED. IN CASES WHERE SALVAGE EXCAVATION IS <br /> NECESSARY, THE COST OF SUCH EXCAVATIONS SHALL BE BORNE BY THE <br /> OPERATOR UNLESS OTHERWISE STATED. <br /> Stipulation No. 51 (TR-38) <br /> IN ORDER TO PROTECT IMPORTANT SEASONAL WILDLIFE HABITAT (BIG GAME <br /> SEVERE WINTER RANGE) , EXPLORATION, DRILLING, AND OTHER DEVELOPMENT <br /> ACTIVITY MAY NOT BE ALLOWED FOR UP TO SIXTY (60) DAYS DURING THE <br /> PERIOD FROM DECEMBER 1 THROUGH MARCH 31. THIS LIMITATION DOES NOT <br /> APPLY TO MAINTENANCE AND OPERATION OF EXISTING FACILITIES. <br /> EXCEPTIONS TO THIS LIMITATION IN ANY YEAR MAY BE SPECIFICALLY <br /> AUTHORIZED IN WRITING BY THE AREA MANAGER, BUREAU OF LAND <br /> MANAGEMENT. <br /> Technical Revisions <br /> TR-36 proposed approval decision was issued June 19, 1995. The <br /> revision addressed welding shut of the RP-2/3 and RP-4 pond riser <br /> decant holes, and installation of a valve to control discharge from <br /> pond DP-1 . Riprap installation was proposed for two locations; the <br /> RP-5A pond inlet, and the lower end of the RP-5A undisturbed <br /> diversion ditch at the junction with the natural channel. Revised <br /> text stated that, for ponds RP-2/3 and RP-4, if inflow were to <br /> reduce pond capacity below the 10 year, 24 hour event storage, then <br /> the pond water would be removed as soon as practical to restore the <br /> 10 year, 24 hour event storage capacity. <br /> The decant holes were welded shut, because on at least one <br /> occasion, water which discharged through the decant holes had <br /> exceeded applicable discharge standards.
