Rule 2.05.5(2)(d) states that "For those disturbed areas within the <br />permit area where long term structures or facilities exist or are to be <br />constructed, the applicant may propose specific alternative land uses <br />which may be approved towards the end of the life of the mine through the <br />permit revision procedures required by 2.08. <br />In such cases, the application shall contain a clear demonstration along <br />with supporting information that the pre-mining land use capability will <br />be achieved. <br />This rule precludes the approval of Somerset's proposed end land use <br />change until permanent cessation of mining operations is near enough that <br />substantiated demonstrations can be made to prove the feasibility of the <br />alternative post mining land use and that the pre- mining land use <br />capability will be achieved or exceeded. <br />If you have any further questions or comments please, do not hesitate to <br />contact me. <br />Sincerely, <br />i <~J`-' <br />Steve S.
