The Division has reviewed the letter regarding Somerset Mining Company's end
land use change. The following are comments concerning that letter.
1. This action is considered a significant change to the reclamation plan
and is therefore required to be handled through the Permit Revision
process. (1.04(90), 2.05.5(2)(d)).
2. The Division will notify you, in the near future, concerning a new policy
that addresses requirements for inclusion of building salvage values in
figuring reclamation liability amounts.
3. A decision on the mid-term reclamation bond review is already more than a
year overdue. According to the Division's mid-term bond calculation,
Somerset Mine is severely underbonded. Due to these facts, the Division
requires the mid-term reclamation bond decision be maintained with the
mid-term permit review process. This decision must be made before
December 31, 1992 or an extension must be requested.
4. Requirements of Rules 2.05.5 and 4.16 must be addressed. These include
but are not limited to:
- A detailed narrative of the proposed use following reclamation.
- A discussion of the utility and capacity of the reclaimed land to
support a variety of uses and the relationship of the proposed use to
existing land use policies and plans.
- A copy of the comments concerning the proposed use by state and local
government agencies which would have to initiate, implement, approve
or authorize the use of the land following reclamation.
- Detailed maps of the plan.
- Planning and zoning or other applicable changes.
- Specific plans shall be submitted to the Division which show the
feasibility of the post mining land use as related to projected land
use trends and markets including a schedule showing how the proposed
use will be developed and achieved within a reasonable time after
mining and will be sustained.
- Division of Wildlife and U.S. Fish and Wildlife Service approval of
the post mining land use.
