Long <br />Division Director <br />The Division has reviewed the letter regarding Somerset Mining Company's end <br />land use change. The following are comments concerning that letter. <br />1. This action is considered a significant change to the reclamation plan <br />and is therefore required to be handled through the Permit Revision <br />process. (1.04(90), 2.05.5(2)(d)). <br />2. The Division will notify you, in the near future, concerning a new policy <br />that addresses requirements for inclusion of building salvage values in <br />figuring reclamation liability amounts. <br />3. A decision on the mid-term reclamation bond review is already more than a <br />year overdue. According to the Division's mid-term bond calculation, <br />Somerset Mine is severely underbonded. Due to these facts, the Division <br />requires the mid-term reclamation bond decision be maintained with the <br />mid-term permit review process. This decision must be made before <br />December 31, 1992 or an extension must be requested. <br />4. Requirements of Rules 2.05.5 and 4.16 must be addressed. These include <br />but are not limited to: <br />- A detailed narrative of the proposed use following reclamation. <br />- A discussion of the utility and capacity of the reclaimed land to <br />support a variety of uses and the relationship of the proposed use to <br />existing land use policies and plans. <br />- A copy of the comments concerning the proposed use by state and local <br />government agencies which would have to initiate, implement, approve <br />or authorize the use of the land following reclamation. <br />- Detailed maps of the plan. <br />- Planning and zoning or other applicable changes. <br />- Specific plans shall be submitted to the Division which show the <br />feasibility of the post mining land use as related to projected land <br />use trends and markets including a schedule showing how the proposed <br />use will be developed and achieved within a reasonable time after <br />mining and will be sustained. <br />- Division of Wildlife and U.S. Fish and Wildlife Service approval of <br />the post mining land use. <br />
