_12_ <br />After mining, Colorado Westmoreland Inc. plans to return the land to the <br />pre-mining land uses of grazing for livestock and wildlife for the mine site <br />and orchard land for the loadout facilities. The permit revision will not <br />change the previously approved post-mining land uses. <br />The Division hereby approves the post-mining land uses of the proposed <br />operation. It was determined that grazing for both livestock and wildlife for <br />the bench areas and orchard use for the storage silos, truck dump, train <br />loadout areas, and the railroad spur met the requirements of Rule <br />4.16(2.07.6(2)(1)). <br />III. CULTURAL AND HISTORIC RESOURCES (2.04.4, 2.05.6(4)) <br />In accordance with 2.07.6(2)(e), the Division must make a finding that the <br />proposed mining operation will not adversely affect any publicly owned park or <br />place listed on the National Register of Historic Places. Additionally, <br />although not required by Colorado regulations, within the Federal Regulations <br />there is a further consideration of "cultural and historic resources eligible <br />for listing on the National Register of Historic Places". <br />Cultural, historic and archaeological resource surveys were conducted over the <br />proposed life of mine and adjacent areas. The methodology and results of <br />these surveys are set forth in detail in the Archaeological Appendix in <br />Volume 9. The State Historical Preservation Officer has reviewed the 1983 <br />application/permit revision and the 1986 permit revision and has determined <br />that there are no sites within the permit area currently listed in the <br />National Register of Historic Places. <br />IV. GEOLOGY (2.04.5 and 2.04.6(2)) <br />Fora description of the geology of the mine area and permit revision area, <br />please see the Regional Geology and Ground Water Hydrology portion of Section <br />IX, Probable Hydrologic Consequences and Cumulative Impact Assessment of this <br />document. <br />Information on local and regional geology can be found on pages 15 to 36 of <br />Section 2.04.6, of Volume lA. <br />A total of 11 roof, floor, coal, and interburden samples from existing areas <br />within the Orchard Valley Mine have been collected and analyzed according to <br />the Division's Guidelines. The sampling locations are depicted on Map 6A-8 <br />and results of the chemical analyses are presented in the Waste Disposal <br />section of Volume 6A. <br />In order to monitor the material exposed in the mine on a continual basis, CWI <br />has committed to collecting additional samples of roof, floor, interburden and <br />coal samples at locations depicted on Map 2-5, and at other supplemental <br />locations where inordinate concentrations of waste rock are encountered (i. e.: <br />rgof falls, rockwork, etc.). The results of these geochemical analyses will <br />b¢ reported annually in conjunction with the Annual Subsidence and Hydrology <br />Report (page 32, Section 2.04.6 of the permit application). <br /> <br />
