The topsoil stockpile that is located at the Newlin Creek Mine is not shown on Map 20 -Drainage <br />and Sediment Control or Map 18 -Mine Surface Facilities (showing it is within a disturbed azea). <br />Please add this stockpile to Maps 18 and 20. <br />With the approval of Technical Revision 32 and the completion of the permanent Magpie Creek <br />diversion, please provide the Division with an updated Map 25 -Magpie Creek As-Built. <br />Rule 4.05.2(31 <br />8. The current approved permit lists four small area exemptions (SAE'S) for the mine area -the <br />South Fan, the Rock Dust Storage Facility, the Explosives Bunker and Substation #2. The <br />SEDCAD demonstrations for these SAE's aze for their current (pre-reclamation) condition and do <br />not take into account the fact that the areas will be bare earth during reclamation. For example, <br />the hydrologic inputs for the distwbed areas for the Rock Dust Storage Facility and Substation #2 <br />aze gravel not the bare earth that will exist during/after reclamation. Please update the text in <br />Exhibit 19 and the SEDCAD demonstrations in Appendix C (of Exhibit 19) to reflect reclamation <br />conditions. If the current SAE designs aze not adequate to meet the reclamation conditions, please <br />provide new designs as necessary. <br />9. The SAE for the Roadside Topsoil Stockpile was eliminated from the permit with a revision. As <br />with (8) above, it is the belief of the Division that an SAE is needed at the Roadside Topsoil <br />Stockpile as the mine begins to disturb this azea for reclamation purposes. Please update the text <br />in Exhibit 19 and provide a SEDCAD demonstration for this area along with a plan for the <br />proposed SAE. <br />10. With the elimination of pond 1 for use as a sediment control device, please provide a plan for how <br />runoff from the sediment pond 1 watershed will be contained during backfilling and regrading of <br />the facilities azea to prevent off site impacts. Please provide text and SEDCAD demonstrations as <br />necessary. <br />11. With respect to the topsoil stockpile at the Newlin Creek Mine, please provide a plan to control <br />runoff and sedimentation during reclamation and use of this pile. Please provide text and a <br />SEDCAD demonstration for this azea as needed. <br />Rule 4.05.9 <br />12. With the completion of backfilling, grading, topsoil replacement and seeding, it is the Divisions <br />understanding that no one will be on site at all times. The Division recommends that Pond 4 and <br />Pond 5 be redesigned to include a method for passively dewatering these ponds. Please provide <br />new SEDCAD demonstrations showing that these ponds are able to safely pass a 10-year/24-how <br />storm event. Please update maps 23 and 24 (Sediment Pond No. 4 Design and Sediment Pond <br />No. 5 Design, respectively} to reflect these changes. <br />Rule 4.05.13 <br />13. With the use of Pond 1 as a disposal area for demolition debris, please change exhibit 25 - <br />Hydrologic Monitoring Plan, to reflect that Pond 1 will no longer be monitored. <br />
