EFCI is also working on covering the (formerly) active portion of the refuse pile. <br />Section II -Enforcement Actions <br />Since the permit was renewed, no enforcement actions have been taken. <br />Section III -Revisions to the Permit <br />Subsequent to the permit renewal on 22 June 2001, EFCI has submitted and the Division has approved <br />one technical revision and two minor revision applications. The revisions were as follows: <br />Technical Revision 32 -This revision changed and upgraded the design for the permanent Magpie Creek <br />Diversion. The changes included decreasing the slope of the upper channel to 0.5%, adding riprap drop <br />structures along the upper portion of the channel and riprapping the steeper lower portion of the channel. <br />This revision was submitted on 1 August 2001 and approved on 26 November 2001. <br />Minor Revision 40 -This revision changed the portal seal design in the reclamation plan to conform with <br />30 CFR 75.1711. The plan called for a wall or backstop to be constructed a minimum of 25' inside the <br />portal then the remainder to be backfilled with noncombustable rubble/dirt. This revision was received <br />on 19 November 2001 and approved on 29 November 2001. <br />Minor Revision 41 -This revision requested the permanent retention of the existing coal reclaim tunnel <br />and the use of Pond 1 as an alternate disposal site for demolition debris (pond 1). Along with the <br />revision, EFCI submitted a SEDCAD demonstration that pond 5 could hold all or the runoff from a 10- <br />year/24-hour storm event from both the pond 5 and pond 1 watersheds. This revision was received on 7 <br />December 2001 and approved on 18 January 2002. <br />Section N -Status of Stipulations <br />At the time of the permit renewal, 6 stipulations were in effect, as all previous stipulations had been <br />complied with and terminated. Stipulations in effect at the time of the renewal, and their current status, <br />are as follows. <br />Stipulation No. 4 <br />WITH RESPECT TO THAT PORTION OF THE COAL LOAD-OUT LOCATED WEST OF THE COUNTY ROAD 79 <br />IDENTIFIED AS AN ALLUVIAL VALLEY FLOOR, WITHIN TWO YEARS AFTER THE COMMENCEMENT OF THE <br />PERIOD OF EXTENDED LIABILTTY AS SPECIFIED IN RULE 4.15.7(5), THE OPERATOR SHALL COMPARE THE SOIL <br />CHARACTERISTICS OF THE RECLAIMED AREA WITH AN ADJACENT UNDISTURBED AREA. THIS COMPARISON <br />SHALL BE SUFFICIENT TO VERIFY THAT THE INFILTRATION, PERMEABILITY,A ND TEXTURAL CHARACTERISTICS <br />OF THE RECLAIMED SOILS HAVE BEEN RE-ESTABLISHED SUFFICIENTLY TO RENDER THE AREA AS <br />POTENTIALLY FLOOD IRRIGABLE. <br />Status: Continued -future submittal required. <br />Stipulation No. 9 <br />THE OPERATOR SHALL POST AND MAINTAIN "STEEP SLOPE CAUTION SIGNS" ALONG THE ACCESS ROAD TO <br />THE REFUSE DUMP.
