Stipulation No. 1 <br />SIX hIONTHS PRIOR TO THE UkIVING OF ROCK SLOPES WITHIN THE MUNGER <br />CANYON MINE FROM THE CAMEO COAL SEAM TO THE UPPER CARBONERA COAL <br />SEPM, THE APPLICANT MUST SUBMIT GEOCHEMICAL AND PHYSICAL ANALYSES <br />OF THE UPPER CARBONERA ROOF AND FLOOR STRATA HND ALL INTERBURDEN <br />STRATA BETWEEN THE CAMEO AND UPPER CARBONERA COAL SEAMS WHICH WILL <br />BE ENCOUNTERED IIJ THE ROCK SLOPES. <br />Stipulation No.L <br />WITHIN SIX MONTHS OF PERMIT ISSUANCE AND PRIOR TO CONSTRUCTION OF <br />THE SEDIMENT Pl1NDS AT THE MINE BENCH AND AT THE WASTE DISPOSAL <br />SITE, THE PERMITTEE MUST SUBMIT AN AP PROVABLE PLAN TO INSTALL <br />DEWATERING DEVICES TO DEWATER THE PONDS TU THE MAXIMUM SEDIMENT <br />STORAGE LEVEL. ALSO, THE PERMITTEE hiUST COMMIT TO INSTALLING <br />MARKERS TO INDICATE THE 60% SEDIMENT STORAGE LEVEL AT BOTH SEDIMENT <br />PONDS. <br />Stipulation No. 3 <br />THE PERMITTEE MUST SUBMIT TU THE REGULATORY AUTHORITY AN ANNUAL <br />REPORT CHARACTERIZING THE INFLOWS, DISCHARGES ANU THE CONSUMPTION <br />OF WATER WITHIN THE MINE. THIS REPORT IS TO INCLUDE A CURRENT <br />MINE WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF INFLOWS: <br />A TABLE KEYED 70 THE hIINE MAP WHICH SHALL CONTAIN THE SOURCE <br />(i.e., FAULTS, FRACTURES, ETC.), QUANTITY, DURATION, AND QUALITY <br />(i.e., pH, ELECTRO-CONDUCTIVITY AND TEMPERATURE] OF ALL NON-SEEP <br />INFLOWS; A TABLE CONTAINING RECORDS OF WATER DISCHARGED FROM THE <br />MINE, CONSUMED IN THE MINE AND IMPORTED FOR USE WIIHIN THE MINE; <br />A DISCUSSION OF THE WATER BALANCE WITHIN THE MINE; AND, A PROJECTION <br />OF HYDROLOGIC IMPACTS OF MINING IN THE UPCOMING YEAR. <br />Stipulation No. 4 <br />SALT CREEK h1INING COMPANY SHALL INSTALL NND hIUNITUR THE PROPOSED <br />MONITORING WELL GW-6 ONE YEAk PRIOR TO THE CONSTRUCTION OF THE <br />MUNGER CANYON MIfVE WASTE ROCK PILE. WATER QUALITY SAMPLES AND <br />WATEK LEVELS SHALL BE TAKEN QUARTERLY. MONITORING SHALL BE SUB- <br />MITTED TO THE kEGULATORY AUTHORITY QUARTERLY. <br />Stipulation No. 5 <br />THE NPPLICANT SHALL NOT MINE MORE THAN 100,000 TUNS OF COAL <br />ANNUALLY UNTIL THEY HAVE OBTAINED A REVISED AIR QUALITY PERMIT <br />FROM THE COLORADO DEPNRTMENT OF HEALTH FUR THE HIGHER PRODUCTION <br />LEVEL. <br />Stipulation No. 6 <br />WITHIN b MONTHS OF PERMIT ISSUANCE, THE PERMITTEE MUST PRUUIDE THE <br />REGULATORY AUTHORITY WITH AN ANALYSIS OF THE FILL (DISTURBED LANDS) <br />AND NNY OTHER DISTURBED MATERIAL WHICH WILL NOT BE TOPSOILEO PRIOR <br />TU REVEGETATIUN. THIS ANALYSIS WILL 6E DONE ON AN APPROPRIATE <br />NUMBER OF REPRESENTATIVE SAMPLES TAKEN TO A DEPTH OF AT LEAST 4 <br />FEET, AIVD WILL INCLUOE ALL REQUIRED PARAMETERS FOR A DETERMINATION <br />OF SUITABILITY FOR RECLAMATION. <br />Stipulation No. 7 <br />TOPSOIL MUST BE ANALYLED FUR FERTILIZER ELEMENTS PRIOR TO <br />SEEDING. IF THE SOIL IS FOUND TU BE PHOSPHOROUS-DEFICIENT, <br />PHOSPHOROUS MUST BE INCORPORATED INTO THE TOPSOIL DURING THE <br />RESPREADING PROCESS. ANY OTHER FERTILIZER ELEMENTS WHICH ARE <br />DEFICIENT IN THE TOPSOIL MAY BE ADDED AFTER ONE YEAR"S GROWTH <br />OF VEGETATION AT A TIME OF YEAR APPROVED BY THE DIVISION. <br />Stipulation No. 8 <br />WITHIN ONE YEAR OF PERMIT ISSUANCE, THE PERMITTEE WILL SUBMIT A <br />PLAN TO THE REGULATORY AUTHORITY FOR SURFACE MANIPULATION OF THE <br />SOILS TO ENHANCE MOISTURE RETENTION ANU REDUCE EROSION DURING <br />RECLAMATION. THIS PLAN WILL BE REVIEWED BY THE DIVISION AND <br />INITIATED BY THE PERMITTEE DURING RECLAMATION. <br />
