#s

CWL was damaged, we had to hire an Attorney to help
represent us in this 2 - 2 1/2 acre disputed area along with
the pine tree that was in this area. I personally have
spent countless hours in arguing with the state, and writing
letters. CLW was damaged.
The north and the south end of Chens hill are the areas of
concern to CWL. CWL asked for the south end of Chens hill
to be staked the way the maps depict it. The state refused.
This doubled the volume of dirt to be moved, and instead of
pushing it straight down with the dozer it had to be hauled
with a scrapper. This added great expense and time.
The State of Colorado DID NOT STAKE ANY PERIMETERS AT ANY
TIME on this job. This staking for task 11 was done by CWL
employees, and CWL would like to be paid for the expense of
having to work without staking and then having to stake it
ourselves.
# 9
The issue is not the number of
proximity to one another. The
for them to be 150 feet apart.
feet apart. This caused sched
no room between the structures
than one at a time.
structures, but their
original bid documents call
When built the were about 50
cling problems. As there is
to allow you to work on more
# 10
This damage happened primarily in areas that had no topsoil.
This does constitute a change of conditions.
# 11
The states offer is no where near the actual cost to produce
these products. Their volumes are also off. Some of this
rock was produced for the riprap channel in the south end of
the trench, which is a different size riprap. You still
have not addressed the additional riprap placed in the
structures at John Nelsons request or the riprap placed in
the far north end where the channel runs off the project.
#12
When I submitted my claim to you about this issue it
identified three people that were involved in this issue,
John Nelson, Dave Bucknam, and Jim McArdle. Then you asked
Bill Colgate for verification. You need to ask Bucknam and
Nelson.
7
