by said prior surface leases to which lessor is unable to obtain such amendments,
<br />it shall be the responsibility of lessee at its own expense to obtain all necessary
<br />relinquishments of any areas covered thereby as may be required by lessee for
<br />its o erations under this lease, Lessor agrees that all surface leases issued, a~
<br />XJ`-"Lii, or extended on or after the date hereof shall contain, as issued, renewed,
<br />i ~ ' ~/~ or extended, the aforementione:; provisions concerning relinquishment.

<br />That lessee agrees to protect the tights o£ persons holding such surface
<br />~ leases, and to cay any damages lawfully awarded t~ :.:ch persons as a result of
<br />lessee's opera.:on~ u,:der this lease, and lessee furu.~r frees to erect fences
<br />and keep closed ~aLCb in all fences and to close or fence ...: holes or open cuts
<br />for the protection .;: livestock lawfully grazing on the leasrc premises; provided,
<br />however, that lessee shall not be liable to or on u- _~...n. c.. 4ay person holding
<br />such a surface lease which was issued, renewed or e.::,,....ad or. or after the date
<br />hereof, or which was amended in accordance with the p.. .sicr.~ of the preceding
<br />paragraph, where damage occurs to, or any claim arises ouc ~_ or in connection
<br />with, land leased by such person included within this lease or -ops, livestock
<br />or improvements thereon, withespect to which land lessee she.. have notified
<br />lessor of its intention to commence stripping operations or to c..nstruct improve-
<br />ments thereon at least one hundred twenty (120) days prior to the occurrence of
<br />damage thereon or the happening of the event thereon giving rise :o any claim,
<br />if grazing land, or, if agricultural land, wlier.-; such notification shall have been
<br />given on or before the 13th day of February in any ya,r .n which s,,ch occurrence
<br />or happening takes place on or after the 30th day o, <"• .c,. ,tr, or on or before the
<br />13th day of February in the year preceding any year .r. .;:ich suci:.~ccurrence
<br />or happening tar:eo place prior to the 30th day of October.
<br />Less.:r shall promptly notify lessee of the issuance, r...:~wal or exten-
<br />sion, on or ,.ter the date hereof, of any surface lease covering ar-y portion of the
<br />leased prem::..,s, and shall supp:y lessee as quickly as may conveniently be done
<br />with copies :all of such s::rface leases, renewals or .:xtensions, and with copies
<br />of any amer.oments t}rreto or co existing surfa.:e lease, as the same are made.
<br />13. INDEMNLFICATION OF LESSOR -The ias:,:~ o~:ees to hold the lessor
<br />harmless for any and all manner of claims arising or to ari.;, from the operation of
<br />said leased premiss c.y said lessee, whether from soil or sup :ace subsidence or
<br />from any other i:a~ise attributable to lessee's operations hereunder, excepting,
<br />however, clai,..~ arising under the circumstances set forth in the proviso contained
<br />in the sec:.,. rnragraph of Paragraph 12 hereof.
<br />14, INSURANCE -Lessee shall furnish gulden,.: :, insurance coverage,
<br />in form and amount satisfactory to the lessor, for the _:u.;,iity assumed by lessee
<br />und,:r Paragraphs 12 a:d 13 hereof.
<br />15, TA}CES -Lessee shall pay all taxes lawfully assessed on property of
<br />lessee located on the leased premises.
<br />16. RIGHT OF REMOVAL - It is agreed that in the event this lease is
<br />terminated, by forfeiture, surrender or the expiration of its term, the lessee may,
<br />subject to the provisions of Paragraph 19 hereof, remove all improvements and
<br />equipment from said premises other than actual plant sites withinrune (9) months
<br />from the date of such termination, and all improvements and equipment from actual
<br />plant sites within two (2) years from the date of such termination, and the same
