<br />premises during the preceding six (6) months' period, and semi-annually shall
<br />also furnish a map yr blue print of survey of pits, a~;o~+_;.;, outside contours,
<br />depths and thickness of coal, with location of same tied t:. a corner established
<br />by United States Surveys of some land subdivision, car,.=:.:~ to by a licensed
<br />engineer or surveyor as provided for in the Colorado Mining Code of the State
<br />of Colorado,
<br />5. INSPECTION - It is agreed that during all proper ho,:rs and at all
<br />times during the continuance of this lease the lessor by its Superintendent of
<br />the Mineral Department or by its duly authorized agent or agents, shall be,
<br />and hereby is authorized to check scales as to their accuracy, to go through
<br />any of the slopes, entries, shafts, openings, or workings on said premises, and
<br />to examine, inspect, survey and take measurements of ..... same and to examine
<br />and make extracts or copies of all books and weight si.=cts ~ti~i.ich show in any
<br />way the coal out~u~ of the leased premises, and that ~i..;onveni;:nces necessary
<br />for said inspection, survey or examination shall h: furntsntd to t:.e lessor, its
<br />Superintendent of the Mineral Department or its agent ;,r agents ay the lea see.
<br />6. MINING IvIETHODS - In the underground and open pit workings, all
<br />shafts, inclines and tunnels shall be well timbered (when good mining requires
<br />timbering) and all parts of workir~-,, where coal is not exhausted, will be kept..
<br />free from wac::r and waste materials, as in ordinary operations. Tits underground
<br />and open pit workings shall be protected against fire, floods, creeps and squeezes.

<br />7, RICH"!'S OF WAY - It is agreed that the lessor reserve; the right to
<br />grant rights o: ~vay over said premises for public roads, railr~au~, power, tele-
<br />graph, teleph.~ne, ditch and canal lines; but such grants shall be so made as not
<br />to interfere w.:h the operations of the lessee,
<br />8, NOTICES - It is agreed that any notice required or permitted to be
<br />given to the lessee under the provisions of this lease, shall be sent by registered
<br />mail to lessee at 550 California Street, San Francisco, California, or such other
<br />address as lessee may indicate in writing to lessor, and such service of notice
<br />by mail shall be deemed sufficient and in full comp.iance wit:: ti;e terms of this
<br />lease, Notice to lessor shall be given in like manner, son: eased to State Board
<br />of Land Commisaioners,'State Services Building, 1525 Sherman Street, Denver,
<br />Colorado.
<br />9. ASSIGNMENT - It is agreed that no assignment or transfer of this lease
<br />will be held valid by the lessor, unless made with its consent in writing and duly
<br />entered in the books of record of said Board, which such consent shall not be
<br />unreasonably withheld,
<br />10. PROSPECTING,- Lessee agrees that while usir~d ,,:d operating
<br />any diamond, churn or other drill on said premises, it will k.:~p an accurate
<br />log on all work so done'and performed, showing geological formations penetrated,
