the total number of acres so relinquished bears to the total of number of acres <br />covered by this lease. Such minimum advance royalties paid on the lands contained <br />in this lease and the minimum advance royalties .paid on the lands contained in that <br />certain Lease Agreement dated May 1, 1954, covering 9882.61 acres in Township <br />6 North, Range 9i West of the 6th P. M. , Moffat Cvt.nty, Colorado, shall be credited <br />against the first royalties to become due as hereinafter set forth under Parpgraph 2 <br />hereof for coal actuaily tr.ined during the year for witicr~ ~ .;.h minimum royalties <br />were paid, and the reaicer as nereinbelow provided. <br />It is understood that the minimum royalties above set .urth are minimum <br />royalties payable annually, and are due and payable to lessor w~i-.ether coal is mined <br />or not during such year, and t]ie amount so paid in any year as minimum royalties <br />in excess of amounts of coal actually mined in such year shall be npplied and <br />deemed as an advance payment of royalty on coal actually mined in any subse- <br />quent year or years in excess of the minimum provided for herein for such sub- <br />sequent year or years. <br />2, ACTUAL kOYALTIES - That.in adaition to ai, ;.her considerations to <br />be performed by le.;see, lessor hereby reserves and less.. ..grees to pay to <br />lessor for the right and privilege of mining coal upon the above described prem- <br />ises the following royalty: <br />A royalty of 15 cents per tan on all mere. cable, clean <br />mine-rttn coal mined from said premises. <br />That suci, royalty shall be due and payable on or befora ~;.: 25th day of <br />each and every calendar month during the term of this lease for cos: mined during <br />the preceding calendar month. <br />3. WEIGHT OF COAL - It is agreed that ail c~ .. REPORTS - It fie agreed that on or before the twenty-iiftlt day of each <br />and every month during the term of this lease the lessee shall make a sworn re- <br />port to the lessor, in which shall be entered and set down the exact amount in <br />weight of all coal mined on said premises during the preceding calendar month, <br />which said report shall be made whether any coal is mined or not, and shall <br />show the amount of work performed during the preceding calendar month; and <br />said lessee shall also, during the term of this lease, on or before November 25th <br />-4- <br />
