SENT BY~PMHS ~ 4-26-94 ~12~02PM ~ 3032953040 303 632 6106~it 6
Robert ICraaea, Esq.
April 2s, 1994
page -2-
agreed informally to relocate several of Lhe drill holds. Thai
will minimize disruption to the surface and, consequently, costs o!
reclamation to Basin. We will indicate to the Division of Minerals
and Geology where we have changed such locations within the
boundaries of TR-#'28.
while it makes sense, where and when possible, to drill during
dxy weather, the drilling s.ehedule may not allow strict adherence
to such a schedule and Basin cannot contract such a limltation. Of
couran, as required by state lav, Sasin will repair damage to roads
and will reclaim drill pads.
Basin has proposed a groundwater monitoring plan which will
result in several o! the drill holes also being used as groundwater
monitoring wells. For drill holes that are not to be used for such
purposes, or !or other, purpoaes, Basin has an obligation to fill
the holes eontemporaneoualy with site reclamation. We are open to
requests to attempt to amend such obligationo in specific cases, if
approached by individual property owners. However, we are
unwilling to.agree to a blanket request which would increase costa
substantially.
Al l.reciamation requirements of the Division must ba complied
with, therefore the paragraph requiring a separate contractual
obligation is redundant.
It you have any questions regarding this letter, please do not
hesitate to call me.
urs ly,
Je ray H.
