Raton <br />West/Baldwin Ltd., on lurch 16,:1994, requested public haarlnq on <br />this revision. The. hearing is:schadule for Thursday afternoon, <br />April 2a. You have indicated that in the event Basin Resources, <br />Inc. agrees to the proposal, Raton West will withdraw its request <br />-.. _._. _ <br />for=hearin ' <br />g.- -- _.. . -- -.. ... <br />Basin is unable to reach agreement as proposed. We note that <br />only four of the holes intended to be drilled in 1994 are within <br />the current mine permit boundary, therefore they nre the only holes <br />properly the subject of the MLRB hearing. Those holes, namely NM- <br />21, NK-25, NM-27.and NM-28, apparently are all on lots that nre no <br />longer owned by Raton west. One of.tha holes, NM-25, is intended <br />to be placed Q~ the Rancho Escondido boundary, and the Raton west <br />proposal would change that location to one within the boundaries of <br />a lot currently owned by a third party. <br />we are unable to agree to the proposal for a number of <br />reasons. Firct, as you correctly indicated, Raton West is not the <br />owner of the surface on which the activity will take place. Raton <br />West' is not properly a party with which Sasin should have <br />disouseione regarding th¢ exploration. Basin~e proposed plan vas <br />submitted to the .Division.
