Section IV- Status of Stipulations <br />All stipulations from the original permit were resolved prior to the issuance of the permit <br />renewal in 1993. <br />Section IV -Decision to Require Revisions <br />As a result of this midterm review, the Division will require revision(s) of the permit to <br />address the following concerns with the currently approved New Horizon Mine permit <br />application. <br />1. DMG Application Form, pages 3 and 4. Please update the acreage amount to reflect <br />current conditions showing the total permitted acreage, affected acreage, and <br />disturbed acreage. <br />2. Rules 2.03.4(3)(a),(b),(c): Please update personnel changes to any corporate officer <br />or owner and controller positions and include the date the person assumed or was <br />removed from that position. Please indicate the percentage of ownership in the mine <br />that each of these officers retain. <br />3. Rule 2.03.4(3)(d): Do any of the people identified above own or control, or within <br />the last five years owned or controlled, any other surface coal mining or reclamation <br />operation under any other names other than those listed in the permit? [f so, please <br />update this section. <br />4. Rule 2.03.4(4): Please update [his section as necessary. <br />5. Rules 2.03.4(6),(7): Please update these sections with current names and addresses as <br />necessary. <br />6. Rule 2.03.4(9): Please update this section and page 2.03-13 with the current <br />information. <br />7. Page 2.04.6-4: The permit states "There is approximately 12.] feet of interburden <br />separating these seams within the New Horizon 2 permit area:' A review of the <br />information presented in the same paragraph indicates that this should be 7.5 feet. <br />Please correct the discrepancy. <br />8. Page 2.04.7-2: In the paragraph that begins "Overburden Water Levels", a sentence <br />reads "There are no overburden monitor wells located at the New Horizon 1." This <br />conflicts on that same page with the last sentence of the next to last paragraph that <br />reads "Mining at the New Horizon 1 area has hacl no discernible effects on the water <br />levels of the overburden monitor wells". Please clarify this statement. <br />9. Page 2.05.4(2)(d)-7: Paragraph 4 contains the statement that "One lift topsoil will <br />generally be isolated from the two lifts during all soil handling operations". The word <br />generally should be deleted since according to the approved reclamation plan, there <br />should be no mixing of the two lift soils and the single lift soils. Additionally, please <br />be aware that D70B soils need to be stored separately from 30C soils. <br />Midterm Review - New Horizon Nine 3 November 1995 <br />
