the technical and other revisions summarized in the following
correspondence, which is attached to the Declaration at ~ 9:
(a) November 8, 2000 letter from David Berry, Coal Program
Supervisor, to Jim Stover at Powderhorn (Exhibit A to the
Declaration);
(b) February 18, 2000 letter from Dan T. Mathews,
Environmental Protection Specialist, Division of h]inerals and
Geology, to Powderhorn's agent, Jim Stover of J.E. Stover and
Associates (Exhibit B to the Declaration);
(c) February 18, 2000 Revision Order, attached to the February
18, 2000 letter, above.
If Powderhorn does not faithfully perform the reclamation
work, the water in Powderhorn's underground mine adjacent to
I-70 will build up, and there is a likelihood that a major
uncontrolled discharge of water and debris will flow out of
the Northwest Intake Portal of the South Mine onto and across
I-70 and into the Colorado River. This event would result in
an immediate and significant hazard to public health, safety,
and the environment by blocking traffic on I-70 and possibly
injuring members of the traveling public, and by polluting the
Colorado River.
8
