See, the budget attached to the Debtor Quaker
Coal Company's Cash Collateral Order (Exhibit G hereto). What
little money is budgeted for the Debtor Powderhorn is lumped
together; no line items have been earmarked for reclamation
and environmental remediation in Colorado. Moreover, the
monies in the budget for the Debtor Powderhorn are
insufficient to pay for the needed reclamation and
environmental remediation in Colorado.
Allowing the Lenders to receive the Machinery and
Equipment Proceeds poses other major impediments to the
ability of the Debtor Powderhorn to perform its reclamation
and environmental remediation obligations. The Debtor
Powderhorn has de facto abandoned its site in Colorado.5 On
March 14, 2000, the Debtor Powderhorn formally notified the
Colorado Division of Minerals and Geology that it was
permanently ceasing mining operations in Colorado.
