As required by the <br />Colorado Coal Act, Powderhorn posted the Bonds. <br />Powderhorn physically ceased mining operations on <br />December 2, 1999 and gave notice of permanent cessation of <br />mining operations on March 14, 2000. See, inter a1ia: (a) <br />Declaration, ~ 8; (b) December 13, 1999 letter from <br />Powderhorn Mine Manager Ralph S. Salaz to Dan T. Mathews of <br />the Division of Minerals and Geology (Exhibit C to the <br />Declaration); (c) March 15, 2000 letter from Dan T. Mathews <br />to Jim Stover (Exhibit D to the Declaration); (d) March 13, <br />2000 letter from Jim Stover to Dan T. Mathews, (Exhibit E to <br />the Declaration). <br />Therefore, pursuant to its Permit and under 28 U.S.C. <br />~ 959(b), Powderhorn must start to reclaim the site at some <br />time between December 3, 2000 and March 15, 2001. (See, <br />Declaration, ~ 9.) <br />But for the circumstances described below, Powderhorn <br />would have a period of time within which to perform its on the <br />ground reclamation obligations. (See, Declaration, ~ 10.) <br />However, within a total period of 3 years at the most, <br />Powderhorn would have to complete all of the physical work. <br />Powderhorn's Permit requires it to accomplish certain <br />10 <br />
