Memo to BOCC <br />Re: SDE No. 97-01 <br />April 7, 1997 <br />Page 5 <br />2. Continental Materials Corporation has purchased the rights to continue mining <br />activity upon the former Valco properties at this location. Continental will be <br />operating locally as Transit Mix and wishes to purchase the ten (10) acre site <br />surrounding the batch plant and office buildings formerly operated by Valco. The <br />site was identified by a legal description during the map amendment process in <br />1971, for rezoning purposes, but not through the creation of a specific parcel of <br />land separate from the remaining Valco properties. In short, the Valco properties <br />are split by the I-3 and A-2 zone classifications. <br />Staff discussed the options under which Continental Materials Corporation would <br />be able to purchase the property in the manner it desired. Staff provided the <br />subdivision steps and application information to Continental and indicated that, <br />within the A-2 zone district, the minimum acreage which could be purchased <br />without requiring subdivision review would be 35-plus acres. Staff was informed <br />that Continental would purchase a 35-plus acre parcel from Valco, and then <br />process a subdivision request to create the ten acre parcel under the batch plant <br />to be retained by Continental and a remainder parcel, which would be conveyed <br />back to Valco. <br />The title information submitted with the application confirms the purchase by <br />Continental of property in excess of the 10-acre site which is the subject of this <br />subdivision exemption. As this is the case, the applicant shall need to take one <br />of the following steps: <br />a. Prepare a new subdivision application and plat reflecting the parcels <br />involved; or <br />b. Prepare a new deed far the currently owned Valco lands which <br />incorporates the default remainder of the 35-plus acre parcel back into <br />the larger parcel, by description, after the subdivision exemption parcel <br />is created; said deed must be recorded immediately following the <br />recordation of the approved subdivision exemption plat. <br />RECOMMENDATIONS <br />Staff recommends Approval of Subdivision Exemption No. 97-01, with the following <br />conditions: <br />A. Prepare a new deed for the currently Valco-owned lands which incorporates <br />the default remainder of the 35-plus acre parcel back into the larger Valco- <br />owned parcel, by description, after the subdivision exemption parcel is <br />
