This document presents the results of the Division's Midterm Review of the Sunland Mining <br />Corporation's Apex No. 2 Mine permit. This Midterm Review was conducted to fulfill the <br />requirements of Rules 2.08.3, 2.06.2(10), 2.06.3(4), 2.06.7(5) and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, prior to its midterm <br />(2'/x years). Based on this review, for good cause shown, the Division may require reasonable <br />revisions or modifications of the permit provisions to ensure compliance with the Act and <br />Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, mountaintop removal <br />variances, variances from approximate original contour (AOC) and variances from <br />contemporaneous reclamation, respectively, be reviewed by the Division where applicable during <br />the Midterm Review. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and the terms of <br />acceptance of the bond every 2'k years. <br />This Midterm Review consisted of a detailed review of the Apex No. 2 Mine permit application <br />and Findings Document to identify any items that may have been overlooked during the initial <br />review. The Division also reviewed all subsequent revisions and stipulation responses to ensure <br />that all permit commitments and conditions were being followed. Problems and observations from <br />past inspection reports were also considered. <br />SECTION I -HISTORY <br />The Apex No. 2 Mine is located about 6.5 miles northwest of Oak Creek, Colorado, along Routt <br />County Road 29. Mining operations began in 1976 by the Sunland Mining Corporation. On <br />February 4, 1981 Sunland submitted an application for a permit under the Colorado permanent <br />program. A Proposed Decision and Findings of Compliance for permit approval was written in <br />March 1993. Afive-year-term permit was issued on May 26, 1983 and designated C-81-011. The <br />permit azea was 240 acres in size. <br />The mine went into temporary cessation on January 31, 1986. Permanent reclamation activities <br />began in the middle of 1992. Structure demolition began in August 1992. Backfilling and grading <br />operations were performed in September and October of 1992. In eazly November 1992, the mine <br />site was topsoiled and seeded. The total disturbed azea was 3.1 acres. <br />An application for permit renewal was submitted by Sunland on November 20, 1987. A Proposed <br />Decision and Findings of Compliance for Permit Renewal No. 1 was written by the Division on <br />May 16, 1988. A permit renewal was approved with one stipulation oa May 26, 1988, for another <br />five-year term. <br />Sunland submitted an application for Permit Renewal No. 2 on November 30, 1992. On May 5, <br />1993 the Division issued a Proposed Decision and Findings of Compliance for Permit Renewal <br />No. 2. The Permit Renewal No. 2 was approved on May 26, 1993 for another five-year term. <br />
