M-88-112 <br />Dear Mr. George: <br />Since I am lead specialist of the San Luis Project, Mr. H. Bruce Humphries, Minerals Program <br />Supervisor, asked that I draft and submi[ the Division's response to your January 29, 1999 Dean Massey <br />letter. This does not constitute, or represent, BMRI's response to your letter. They will send you a <br />separate letter addressing all your questions and requests (copy of TR-15 etc.). <br />You are correct, BMRI has developed a response plan to address the exceedance of pl~rmit condition <br />values (TDS, Sulphate, etc.) at the M-11R point of compliance as well as addressing the seep south of <br />the West Pic. BMRI, with DMG approval, has drilled, cased and begun testing and mr~nitoring several <br />new monitoring wells in and around the West Pit in order to determine (characterize) the extent (areal <br />and geochemical) of the ground water quality problem. <br />A hearing was held before the Colorado Mined Land Reclamation Board on ]anuary ::6, 1999 in <br />Colorado Springs. The Board did not find a violation of the Ac[ and/or the Mineral' Riles and <br />Regulations but did order BMRI to submit a Technical Revision of the permit by Marsh 31, 1999 to <br />adequately address the water quality problem a[ the San Luis site. The Technical Revision must propose <br />specific actions by the permitee and a schedule of their implementation which will prcvide for the future <br />protection of ground and surface water quality in the area of the West Pit. <br />The Division would like to point out that BMRI continues to monitor the Shalom domestic well. A water <br />sample is collected and tested twice a year at the well. The latest sample was collected on January 20, <br />1999.
