Summary <br />The Review Process <br />On June 23, 2000, Seneca Coal Company submitted an application for Permit Renewal No. 3 for <br />mining and reclamation activities at the Seneca II-W Mine. The application was deemed complete <br />for purposes of filing on July 3, 2000, and the proper notification was sent to parties identified in <br />Rule 2.07.3(3)(b). A public notice of the application was published in the Steamboat Pilot once <br />a week for four consecutive weeks beginning September 30, 1998. <br />On July 22, 2000, the Division requested comments from various Federal and State agencies <br />regarding the permit renewal application. No comments were received regarding the renewal <br />application. <br />The Division issued a preliminary adequacy letter on September 5, 2000. SCC responded on <br />March 23. 2001 and April 24, 2001. Follow-up adequacy letters were sent on May 15, 2001 and <br />May 21, 2001. SCC responded on May 29, 2001. One issue was stipulated, Stipulation 27, and <br />all other issues have been resolved. <br />The Division queried the Applicant Violator System (AVS) on July 19, 2000 to obtain a <br />recommendation for approval of the permit renewal based on the applicant and its owners' and <br />controllers' compliance record. The system recommended the application be conditionally issued. <br />The preliminary adequacy letter addressed the issues regarding the AVS. On June 14, 2001, the <br />Division queried the AVS again. The system recommendation was a conditional issue. The <br />follow up recommendation by the OSM on June 14, 2001 was also a conditional issue. Resolution <br />of the conditional issue requires SCC to provide proof of resolution ofa Kentucky civil penalty <br />violation and bond forfeiture. The same condition was placed on Minor Revision No. 42 and <br />Stipulation 24 was attached to the permit on July 29, 1997. <br />Description of the Environment <br />The Seneca II-W Mine is located in northwest Colorado approximately 7 miles south of Hayden <br />in Routt County. The Seneca II-W Mine lies 7 miles west of the Seneca II Mine, Permit No. <br />C-80-005 and 3.5 miles west of the Yoast Mine, Permit No. C-94-082. See Figure 1 for further <br />detail. The mining area can be found on the Hayden, Hayden Gulch, Mount Harris and Dunkley <br />Quadrangles 7.5 Minute Series Maps. The coal from Seneca II-W is hauled over county and <br />private roadways by private hauler to the Hayden Station Power Plant operated by Public Service <br />of Colorado. Haulage distance is approximately ten miles each way.
