Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations the <br />application for Permit Renewal No. 3 to conduct surface coal mining operations at the Seneca II-W <br />Mine. <br />The application was submitted by Seneca Coal Company. This decision is based on a finding that <br />the operations will comply with all requirements of the Colorado State Program as found in the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations <br />promulgated pursuant to the Act. If no request for a formal hearing is made within thirty (30) <br />days of the first publication of the issuance of this proposed decision, then this decision becomes <br />final. Upon submittal of acceptable surety by the applicant, the permit will be issued. The permit <br />application, all supporting documentation and any stipulations or conditions will become a binding <br />part of the permit. <br />Simulation attached to Permit Renewal No. 3 <br />Stipulation 28: Backfilling and grading of the D pit shall commence by November 15, <br />2001, unless SCC files a complete application in accordance with the <br />requirements of Rule 2.06.7, Variances for Delay in Contemporaneous <br />Reclamation Requirements in Combined Surface and Underground <br />Mining Operations. <br />Stioulation attached to Minor Revision 42- July 29. 1997 Continues in effect: <br />Stipulation 24: Proof of resolution of Kentucky Civil Penalty Violation and bond forfeiture <br />associated with Permit Number 8980140 shall be submitted to DMG as <br />soon as it becomes available. <br />Seneca 1l-W Findings Document 3 June l5, 2001 <br />Permit Renewal No. 3 <br />
