Status of Previous Stipulations <br /> Stipulation No. 50 requires the operator to notify BLM regarding discovery of any cultural <br /> remains, monuments, sites, or objects of antiquity. The stipulation was attached to the permit <br /> via TR-38, and remains in effect. <br /> Stipulation No. 51 specifies that drilling and other development activity may not be allowed <br /> for up to 60 days during the period from December 1 through March 31, to minimize impact to <br /> wintering big game. Exceptions may be authorized in writing by BLM. The stipulation was <br /> attached to the permit via TR-38, and remains in effect. <br /> Stipulation No. 52 specifies that drill sites and access roads constructed pursuant to TR-44 <br /> shall be located as authorized by BLM to ensure protection of archaeological resources. This <br /> stipulation was specific to TR-44. The subject activities were constructed in consultation with <br /> BLM, and the stipulation is no longer applicable. Stipulation 52 is hereby terminated. <br /> Technical Revisions <br /> TR-41 proposed approval decision was issued May 23, 1997. The revision addressed various <br /> road designation changes prompted largely by DMG rule changes, incorporated a "relevant <br /> showing" in lieu of certification for mine haul and access roads, revised the reclamation plan <br /> to indicate that the refuse haul road between County Road 65 and the refuse areas would be <br /> fully reclaimed, and amended the text to clarify that County Road 65 within the permit area is <br /> a public road for which the operator does not have maintenance or reclamation responsibility. <br /> TR-42 proposed approval was issued March 9, 1998. The revision allowed for the combining <br /> of Refuse Disposal Areas RP-2/3 and RP-4 into a single refuse disposal area, RP-2/3/4. The <br /> revision increased the refuse storage capability with minimal additional disturbance, by filling <br /> in a void, which would otherwise have existed between the two areas. <br /> TR-43 proposed approval decision was issued on January 17, 1997. The revision allowed for <br /> disposal of prep plant thickener water within sealed sections of the "D" seam mine workings. <br /> TR-44 proposed approval decision was issued April 22, 1997, with one stipulation. The <br /> revision allowed for relocation of previously approved methane de-gas ventilation hole LW 10- <br /> 1, and allowed for drilling of an additional six ventholes over longwall panel #10. Stipulation <br /> No. 52, attached to the decision, specified that disturbances associated with the revision be <br /> located as authorized by BLM to ensure protection of archaeological resources. In a follow-up <br /> letter of May 5, 1997, DMG forwarded BLM comments which reiterated pre-existing <br /> stipulations 50, and 51, and further specified that during reclamation of well pads and access <br /> roads, any trees removed during construction should be scattered on well pads and access <br /> roads to preclude vehicular travel. <br /> TR-45 proposed approval decision was issued January 15, 1998. The revision allowed for the <br /> required thickness of non-toxic refuse cover material to be reduced from 4 feet to 2.5 feet, and <br /> 4 <br />
