Resource Area, CDOH—Water Quality Control Division, and the Colorado Division of Water <br /> Resources. <br /> February 16, 1999—DMG sent a letter to Bob Leachman, USFWS, in response to a phone <br /> request regarding the Deserado Mine projection of maximum anticipated White River water <br /> depletion. <br /> February 25, 1999—DMG received a letter from SHPO, indicating that there would be no <br /> effect to cultural resources as a result of the proposed renewal. <br /> March 19, 1999—DMG's initial adequacy letter was forwarded to the operator, and copied to <br /> USFWS. The letter focused on hydrologic issues. The letter also requested that BME <br /> document that sufficient payment had been made into the Upper Colorado River Basin <br /> endangered fish recovery fund, or that other measures had been implemented to mitigate the <br /> impact of projected water depletions on the threatened and endangered fish species. <br /> April 19, 1999—DMG forwarded a second adequacy letter to the operator, also copied to <br /> USFWS. The letter addressed concerns with the certificate of insurance, language concerning <br /> sampling of bedrock wells, the need for soils data, evaluation, and handling plan for future <br /> refuse disposal areas, subsidence monitoring plan amendments, refuse pile reclamation and <br /> certification details, sedimentation pond design clarifications, final reclamation sediment <br /> control provisions, White River water depletion projection clarification, and various details <br /> regarding the revegetation plan and demonstrations of revegetation success. <br /> April 27, 1999—DMG forwarded an updated reclamation cost estimate to the operator. The <br /> estimate indicated a projected liability increase of$792, 806.00, with a total estimated liability <br /> of$7,845,563.00. <br /> May 19, 1999—DMG forwarded review comments regarding operator proposal to amend <br /> refuse area maximum slope gradients to be increased from 5h:ly to 4h:1v. The proposal was <br /> deemed to conform to refuse pile stability assumptions and regulatory stability specifications, <br /> as long as the refuse piles comply with the height limitation of 100 vertical feet. <br /> September 3, 1999—DMG received BME's responses to adequacy letters of March 19, April <br /> 19, and May 19, 1999. <br /> September 8, 1999—DMG received BME's comments regarding the updated reclamation cost <br /> estimate. Operator questioned numerous assumptions and cost factors used in the Division's <br /> estimate. <br /> November 4, 1999—DMG received from BME a package of 16 replacement maps with minor <br /> corrections and updates. Map 85 was deleted due to redundancy with other maps. Various <br /> sections of application text were replaced due to formatting problems with earlier submittals, <br /> and to correspond to map changes. <br /> 8 <br />
