' THE SOUTH CHIEFTAIN E <br />ROBINSON BRICK AND ~ COMPANY <br />MINED LAND RECLAMATION BOARD PERMIT <br />APPLICATION #78-13 <br />-3- <br />II. items to be proposed for an agreement between Robinson and the City, <br />separate and apart from the Board. <br />A. Indemnification by Robinson in the event that downslope drainage problems <br />ever occur due to Robinson's mining activities, accompanied by a certif- <br />icate of insurance. <br />B. A committment by Robinson that, if underground water is encountered <br />during the mining operation, Robinson will actively pursue a water right <br />for such water in the name of the City, regardless of Robinson's use <br />or non-use of such water. <br />C. Agreement stipulating that, once reclamation of any area has been <br />completed and accepted by the Board, Robinson will never reopen such <br />reclaimed areas; or alternatively, that Robinson will assign its lease- <br />hold interest in such reclaimed land to the City. <br />D. Agreement that the existing access road to Alameda will continue to be <br />used as the sole access to the mine site. <br />E. Indemnification to hold the City harmless for accidents involving users <br />of the City land and Robinson, accompanied by a certificate of insurance. <br />F. Stipulation of a maximum land area which may be opened at any one time, <br />with reclamation to be performed before additional land is opened. <br />G. Submittal of a performance bond to provide for reclamation in the event <br />that a change of leasehold occurs or if the operation is discontinued <br />for more than one year. <br />H. Agreement that the City be provided an adequate opportunity to review <br />interim and final grading and compaction plans, and recommend such changes <br />as may be reasonable. <br />
