The following items should be brought to the Board's attention along with a <br />request that they consider requiring compliance by Robinson by means of a <br />resubmittal of their South Chieftain Mine permit application. <br />A. An accurate legal description of "affected" land as defined under the <br />statutes, complete and specific enough to allow proper identification <br />of the extent of operations upon City parkland. This legal descrip- <br />tion should be metes-and-bounds with a tie to an aliquot monument, and <br />should include sufficient measurement data to allow an accurate compu- <br />tation of the total land area, in square feet, which is "affected". <br />i Also identified should be the access road to West Alameda, perhaps by <br />means of a center-line and width description. <br />B. Once the proper and sufficient legal description has been given, the <br />surface owners of record should be correctly given for that legal <br />description, in form verifiable by search of the records of the <br />Jefferson County Clerk and Recorder. By the same token, the present <br />record owners of the "substance to be mined" should be given and also <br />verifiable by the same means. <br />C. Exhibit "B" - Mining Plan. The information to be given here should be <br />much more precise and accurate as to the projected limits of the oper- <br />ation as it progresses. This information may very easily and accurately <br />be tied in with a proper legal description as in (A) above. The over- <br />burden fill grading information should also be considerably more <br />specific and should be consistent with the other parts of the application <br />as to slope ratio and so on. Appropriate language should be included <br />here to reinforce the present indication that "total extraction" is <br />being practiced. In other words, once reclamation of any portion of the <br />"affected land", after extraction, has been accomplished and approved by <br />the Board, such reclaimed land will never again be mined for clay by <br />Robinson and/or any future successor to Robinson's leasehold interest. <br />Also appropriate in this exhibit would be a limitation on the maximum <br />land area to be allowed open at any one time. This maximum may be tied <br />to ongoing reclamation so as not to restrict Robinson's activity, yet <br />protect the City and its citizens from a massive eyesore and excessive <br />fugitive dust emissions. A reasonable maximum opened area might be <br />around five (5) acres. <br />D. Obviously, the map for Exhibit "C" is severely deficient. The accurate <br />legal description in (A) above should be shown, as should stockpile <br />areas, adjacent landowners, and access roads. Assuming the "affected <br />area" is, in fact, six acres, a map scale of one inch = 200 feet would <br />be appropriate to show all necessary detail. <br />
