Section IV <br />Enforcement Actions <br />This section is a review of the enforcement actions issued since the last permit renewal (RN- <br />03) in July 2000. <br />NOV 1/C-2000-009 <br />This violation was issued for failure to prevent adverse effects of mining operations; failure to <br />conduct underground mining activities to prevent subsidence from causing material damage to <br />the surface, to the extent technologically and economically feasible, so as to maintain the value <br />and reasonably foreseeable use of surface lands. The NOV was vacated by the Mined Land <br />Reclamation Board on May 24, 2001. <br />Section V <br />Summary and Discussion <br />This section consists of questions or comments raised as a result of the Division's review of the <br />permit application and related materials. As allowed by Rule 2.08.3(3) the Division will <br />require the operator submit a technical revision responding to the issues identified below. <br />Rule 2.05 Operations and Reclamation Plans <br />Please submit a technical revision application to the permit regazding the removal and <br />abandonment of monitoring well LA-264. Please include abandonment reports, if <br />available. for this well. <br />2. Please also include in the technical revision application discussion how the operation will <br />comply with the requirements of Rule 4.OS.13(l) regarding points of compliance. Current <br />permit application text should be reviewed and new text added [ha[ discusses whether or <br />no[ ground water will be negatively impacted and whether a point(s) of compliance is <br />necessary for the operation. Please review the Probable Hydrologic Consequences portion <br />of the permit, baseline data, and monitoring data to provide support of any conclusions. <br />The Division will review this information and make a determination whether of not <br />point(s) of compliance are necessary and if so, potential locations or existing wells to be <br />identified as the point(s) of compliance. <br />6 <br />
