-5- <br />PROPOSED DECISION <br />Colorado Westermoreland Inc. - Orchard Valley Mine <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application for a permit revision to conduct coal mining <br />operations submitted by Colorado Westmoreland Inc. for the Orchard Valley <br />Mine. The Division proposes to incorporate the existing and approved <br />permit area of Permit C-038-81 and the proposed permit revision area <br />together under one permit within one permit area. <br />This decision is based on a finding that the proposed operation will <br />comply with the requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-1U1 et sue., and the <br />Regulations promulgated pursuant to the Act. <br />The finding of compliance, and the stipulations which are apart of this <br />approval, are attached to this document. <br />The permit cannot be issued until all statutory notice and public comment <br />requirements have been satisfied, and until bond has been posted. <br />The permit application and the stipulations will become a binding part of <br />the permit upon approval. The stipulations for the Orchard Valley Mine <br />are as follows: <br />Stipulation No. 1 <br />ONE YEAR AFTER THE COMPLETION OF RECLAMATION ACTIVITIES AT THE <br />LOADOUT, THE OPERATOR SHALL COMPARE THE SOIL CHARACTERISTICS OF THE <br />RECLAIMED AREA WITH THE ADJACENT UNDISTURBED ORCHARD AREAS TO <br />VERIFY THAT THE HYDRULUGIC FUNCTION OF FLOOD IRRIGABILITY HAS BEEN <br />RESTORED. SUCH COMPARISON SHOULD BE IN THE FORM OF INFILTRATION, <br />PERMEABILITY AND TEXTURE STUDIES. <br />Stipulation No. 2 <br />THE OPERATOR SHALL CONTINUE TO SUBMIT TO THE DIVISION AN ANNUAL <br />REPORT OF INFLOWS, DISCHARGES, AND CONSUMPTION OF WATER WITHIN THE <br />MINE. THIS REPORT IS TO INCLUDE A MINE WORKINGS MAP SHOWING THE <br />LOCATION AND QUANTITY OF INFLOWS; A TABLE KEYED TO THE MINE MAP <br />WHICH SHALL CONTAIN THE SOURCE (I.E., FAULT, FRACTURES, ETC.), <br />QUANTITY, DURATION AND QUALITY (I.E., pH, ELECTRU-CONDUCTIVITY AND <br />TEMPERATURE) OF ALL MEHSURABLE INFLOWS; A TABLE CONTAINING RECORDS <br />OF WATER IMPORTED FOR USE WITHIN THE MINE; N DISCUSSION OF THE <br />WATER BALANCE WITHIN THE MINE; ANU FINALLY, A PROJECTION OF <br />HYDROLOGIC IMPACTS OF MINING IN THE UPCOMING YEAR. <br />
