reclaim tunnel (pipe) which is part of the Loadout Facility. The work described <br />in this paragraph 2 to be performed by Contractor shall be referred to in this <br />Agreement as "the Work". The reclaim tunnel (pipe) shall become the property <br />and the responsibility of Eilta upon completion of the Work by Contractor. <br />3. Date of commencement and completion. Contractor shall commence the <br />work on or before October 1, 1991 and shall complete the Work not later than May <br />31, 1992. However, if Contractor shall complete the Work by November 30, 1991, <br />Contractor shall be entitled to remove the electrical transformers presently <br />located on the Property at no extra charge to Contractor, provided they are <br />removed in their entirety and Contractor accepts all responsibility and liabil- <br />` ity therefor. <br />\~ If Contractor does not have all of the Work completed by May 31, 1992, <br />and Sun Coal incurs any expense, costs, legal fees, fines, or the like, as the <br />result of such failure to complete the Work, Contractor shall reimburse all of <br />such expenses, costa, legal fees, fines, penalties and the like, to Owner <br />immediately upon receipt of a statement for same. <br />4. Contractor's duties and obligations. Contractor shall regularly <br />supervise and direct the Work, using Contractor's best skill and attention, and <br />any failure by Contractor to regularly supervise and direct the Work to Owner's <br />satisfaction shall be deemed a breach of this Agreement. Contractor shall be <br />solely responsible for and have control over construction means, methods, <br />techniques, sequences and procedures and for coordinating all portions of the <br />Work under this Agreement. <br />Contractor shall provide and pay for all labor, materials, equipment, <br />tools, construction equipment and machinery, water, heat, utilities, transporta- <br />tion, and any and all other facilities and services necessary for the proper <br />execution and completion of the Work, whether temporary or permanent in nature <br />and whether or not incorporated or to be incorporated into the Work. All costa <br />related to performance and completion of the Work shall be paid by Contractor. <br />Contractor shall enforce strict discipline and good order among Con- <br />tractor's employees and other persons carrying out Contractor's duties and <br />obligations under this Agreement. Contractor shall not permit employment of <br />unfit persons or persons not skilled in tasks assigned to them. <br />-2- <br />~"..: r <br />
