It calls for: <br />(1) Submittal of a replacement financial warranty and establishment of a <br />reclamation trust fund: <br />(2) Revising topsoii replacement requirements; <br />f3) Revising topsoil stockpile, road and diversion canal locations. <br />Financial Warranty <br />Your reouest to submit a replacement warranty and establish a reclamation <br />trust cortrply with Rule 7. Therefore; it is approved in accord,~nce with <br />P.u1e 1.9. I have enclosed copies of forms necessary to substi;,ute a <br />letter of credit for the surety bonds and to establish a reclarnation <br />trust. Diana Bills is responsible for all matters concerning •`inancial <br />warranty in our office. Please contact her about the procedures for <br />implementing the changes. I don't think we've ever had a reourast to <br />establish a reclamation trust fund, so we will be hreaking new ground if <br />you decide to an this route. <br />Topsoil Replacement Reouirements <br />We agreed to defer consideration of this point of your reouest until <br />we've had a chance to inspect the site and evaluate reveaetation <br />monitoring data, As you know, our concern stems from the lack of <br />virtually any successful tailings reveaetation work in Coloradr.. This, <br />combined with the large affected area of tailings will cause us to be <br />very Cautious. In all fairness, I should mention that the only loop-term <br />tailings reveaetation in Colorado was accomplished by Amax at the Urad <br />site. However, all of the techniques used at Urad have not heen <br />transferred, i.e., waste rock cover, so we need to look at the Henderson <br />tailings on a site specific basis.
