The Division will approve the retention of portions of the haul road depicted <br />on Map No. 1 in the permit application package since it is compatible with <br />the approved post-mining land use, if the operator provides the Division with <br />a inquest from the landowner for retaining portions of the haul road <br />(4.03.1(l)(f)(i)). <br />II. Hydrologic Balance -Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />1. The Division proposes to grant a small area exemption from use of sediment <br />ponds due to the limited size of the area and due to the fact that ponds and <br />treatment facilities are not necessary for the drainage to meet the effluent <br />limitations of Rule 4.05.2 and applicable State and Federal water quality <br />standards for receiving streams and also due to the fact that no mixing of <br />surface drainage with a discharge from underground workings will occur. <br />The small areas to be exempted are the areas at the water storage tank, <br />explosives storage, ventilation entry, alluvial well pump, Hal:tndras trash <br />dump, the overland conveyor, topsoil stockpiles, the South and East portions <br />of the Slot Storage area, SDH #4, "V" -ditch and culvert, mad base stock- <br />pile, East Portal area drainage and sedimentation control, East Portal storage <br />pad azea, radio tower, staging area neaz Transfer 1, and de asrf '` <br />bore oleh pads. Stream Channel Diversions <br />The Division approved the diversion of an ephemeral stream draining at least <br />one square mile. Scullion Gulch has been diverted with a large diameter pipe <br />culvert such that it passes beneath the D Portal facilities area. The decision to <br />approve this diversion is based on a finding that the proposed diversion meets <br />the requirements of 4.05.18 and 4.05.4, applicable local, State, and Federal <br />statutes and regulations and that the diversion is designed to safeguazd public <br />safety and to minimize adverse impacts to the hydrologic balance (4.05.4(1) <br />and (4)). <br />C. Surface and Ground Water Monitoring <br />1. The applicant will conduct monitoring of ground water in a manner approved <br />by the Division.
