r <br />2. If the power poles are no longer functional, please describe the plan <br />for removing these structures (Rule 2.05.3(3)(a)). <br />3. Were all drill holes reclaimed? If so, please provide a copy of the <br />abandonment reports per 2.02.6(3)(b> and 4.07.3(3). This relates to <br />Stipulation 17. If not, please propose a plan for completing these <br />activities. <br />4. There is evidence of water in the pit during mining (inspection reports <br />and aerial photographs). Since this was to be a "dry mine" plan, <br />please provide an explanation for the presence of this water and any <br />potential off-site effects (Rule 2.05.6(3>(b>(iii)). <br />5. Please provide updated owner and controller information (Rule 2.03.4) <br />as required by the new definition in the Coal Regulations (1.04(83a)). <br />This will allow us to update our AVS system and obtain updated <br />compliance information. <br />6.. Please submit two copies of the most recent NPDES permit and/or <br />stormwater management plan permit (Rules 2.03.10 and 4.05.2(7)). <br />7. In addition to these concerns, this revision should clarify the <br />vegetation success standards (Rules 4.15.8 and 4.15.10). The <br />vegetation success standards were assigned by the Division, but <br />apparently were never properly incorporated into the permit application. <br />On pages 2.05-46 through 2.05-50, several pieces of correspondence are <br />included which define what standards will be utilized for vegetation <br />success. However, on pages 2.04-71 and 2.04-72, this information does <br />not seem to be incorporated, and outdated information is still in the <br />permit application. Both of these sections need to be cleaned up by <br />incorporating relevant information and deleting nonessential <br />information. Also, correspondence should be included as an exhibit. <br />8. In satisfying Stipulation 7, the pest control plan (Rules 4.18(5)(8) <br />and 2.05.4(2)(e)(v)), simply indicate that the Division will be <br />notified about target pests and control methods at least 30 days prior <br />to treatment. <br />9. Please address grazing activities in a similar format per Rule 4.15.5. <br />Commit to Division notification of stocking numbers and duration <br />periods prior to implementation. <br />10. Please indicate the outcome of the approval of Minor Revision 3 and the <br />circumstances surrounding the outcome per the rhetorical question in <br />Section II of this document. <br />Section V. - Bonding <br />11. Our records indicate that we currently hold a Letter of Credit <br />(No. 216418) from the Bank of America in the amount of $100,000 as bond <br />for the remaining reclamation activities.
