~• <br />Stipulation No. 11 required the operator to submit a proposed format for <br />semi-annual subsidence monitoring reports. Subsidence monitoring reports have <br />been submitted semi-annually as required. The permit contains a commitment to <br />continue this reporting. Therefore, this stipulation is no longer necessary. <br />The operation is in compliance with the requirements of this section, <br />XXI. Miscellaneous Compliance - Rules 2.05.4, 4.02, 4.12 and 4.21 <br />There are no changes in this section. Information on signs and perimeter <br />markers, slides and other damages and, exploration is found in the MRP in <br />Sections 4.02, 4.12 and 4.21, respectively. <br />The operation is in compliance with the requirements of this section. <br />XXII Operations on Lands Subject to Limitations or Prohibitions - <br />kuies z.us.i, z.ui.b ana z.iu <br />There are three areas within the Southfield permit area subject to limitations <br />under Rule 2.07.6(2). These are: <br />1. Fremont County Roads 72, 92 and 115 pass through the permit area. A <br />letter from the Fremont County Commissioners approving mining within <br />100 feet of county roads is included in Exhibit 4 of the permit. <br />2. The mine permit area is within 300 feet of an occupied dwelling <br />(Thompson Ranch). A signed waiver of consent is included in Exhibit 2 of <br />the permit. <br />3. The load-out is within 300 feet of an occupied dwelling. A signed waiver <br />and consent agreement from the landowner is included in Exhibit 2 of the <br />permit. <br />In accordance with Rule 2.07.6 (2 )(d ), the Division finds that the operation is <br />not within an area designated unsuitable for coal mining or subject to any of <br />the restrictions in Rule 2.07.6 (2 )(d ), with the exception of the approved <br />variances mentioned above. These variances are approved based on information <br />provided by the operator as allowed in Rule 2.07.6 (2 )(d)(iv) and (v). <br />The operation is in compliance with the requirements of this section. <br />XXIII.Demonstration That Surface Coal Mining and Reclamation Operations Can <br />~-r•; ~;xr.,-fi ,.,,m.,r, x~- _ trr-r-rtr-~ ~rn~ <br />There are no changes in this section related to the existing permit area. In <br />accordance with Rule 2.07.6(2)(d)(b), the Division finds that coal mining and <br />reclamation operations can be feasibly accomplished within the proposed permit <br />expansion area, <br />The operation is in compliance with the requirements of this section. <br />-23- <br />
