the Permit Revision No. 1 application, worst case reclamation costs for ,the <br />first five-year permit term were recalculated by Peabody to account for mining <br />in new areas and other modifications to the previously approved mine plan. <br />The initial estimate of E1,086,408.00 was reviewed by the Division in detail, <br />revealing a few minor deficiencies in the calculations. An outline of all <br />deficiencies noted during the review was forwarded to Peabody. The permittee <br />responded to each of the Division's concerns with a revised cost estimate of <br />;1,347,246.00. This revised bond amount was reviewed and accepted by the <br />Division. <br />The net additional bond coverage required to be posted as part of the permit <br />revision approval (5665,174.00) is calculated as the difference between the <br />revised bond total (E1,347,246.00) and the previous bond tota] calculated at <br />the time of issuance of the first five-year permit (5682,072.00). <br />The E665,174.00 required additional bond coverage for the permit revision must <br />be submitted to and accepted by the Division prior to final approval of the <br />permit revision application. As such, the following stipulation is necessary. <br />STIPULATION N0. 1: <br />A PERFORMANCE BOND FOR THE NUCLA MINE, IN THE TOTAL AMOUNT OF $1,347,246.00, <br />PAYABLE TO THE STATE OF COLORADO, MUST BE FILED WITH THE DIVISION WITHIN FIVE <br />DAYS AFTER THE DECISION BECOMES FINAL. <br />XXII. Sealing of Drilled Holes and Underground Openings - Rules <br />Information pertaining to sealing of drill holes is presented in Volume 9, Tab <br />12. Since this is a surface mining operation, the requirements pertaining to <br />sealing of underground openings is not applicable. <br />The operation is in compliance with the requirements of this section. <br />XXIII. Subsidence - Rules 2.05.6(6) and 4.20 <br />The Nucla Mine is a surface area strip mining operation, therefore, the <br />requirements of this section are not applicable. <br />XXIV. Special Categories of Mining Other than Alluvial Valley Floor and <br />Prime arm an - Ru es an 9 <br />The Nucla Mine is not a combined surface and underground mining operation <br />(Rule 4.22); has no auger mining (Rule 4.23); is not a mountain top removal <br />operation (Rule 4.26); has no operations on steep slopes (Rule 4.27); has no <br />coal processing plants and support facilities located at or near the mine site <br />or within the permit area for the mine (Rule 4.28); and is not an in-situ <br />processing operation (Rule 4.29). Therefore, the requirements of these <br />sections are not applicable. <br />-30- <br />
