They are listed below. <br />t. In cross-section F, a depression of approximately 43.75 feet appears. <br />he general regrading requirements of the Seneca II permit, Section <br />„ ,!J 14.2(3) states, "Small depressions are not proposed in the post mining <br />~'( opography except where they were pre-existing." Because of unavailable <br />pre-mining topographic maps, I was unabl to tell if the depression v/as <br />pre-existing. Cross-sections C & D show more material in place than proposed, of <br />approximately 50 feet more depth in cross-section C and approximately <br />30 feet more depth in cross-section D. In his letter of July 7, 1989, <br />Ron Gehrke states, "We do not believe this area to be a problem, but will <br />observe the future grading to ensure that adequate material is available <br />to reclaim the future pits." He has not stated how he plans to ensure <br />adequate material for the future. Also, it is not clear why more <br />material was put down in the first place. <br />3. In these areas where more material was placed than proposed <br />(cross-sections C, D, and E), nothing is said of stability <br />~o-~ e. I Z - S 7 <br />The general grading requirements of the Seneca II Permit, <br />^4r1-4:271T states, "The final graded slopes will not be uniform, but will <br />approximate the pre-mining slopes as shown by Exhibit 12-9, Post-Mining <br />Contour Map." I am unable to understand how Peabody Coal Company can <br />show pre-mining topography on a post-mining topography map.
