•
This condition has been completed. Only active or immediately pending grid have been
located for lands already affected, or to be affected within the next 12 months.
#6 A. Obtain al! required State/Federa_permits. Staff is aware that permit have been
applied for by the operator. A copy of the APEN permit or exemption is ne ded. Staff
realizes that the timing of the issuance of this permit is beyond the operator's control. If
this has not yet been issued, please indicate what you know about the current atus of the
request with the Colorado Deparhnent of Public Health and Environment.
We forwarded three copies of the approved APEN when i[ was received om CDH.
Unfortunately, we did not document proof of receipt, so we ane providin copies, in
triplicate, as requested.
NtS. B. Obtain Buildingpermits. Permits are needed for the tool storage she and office
structure on this site. /f other structures are present or contemplated, please check with
staff regarding any permit requirements. You may wish to talk with the Cou ty Building
Deparhnent about the permit submittal requirements and the type of plans that are needed
for your structures. Building permit applications require a site plan showing th location of
the structures. You could probably use the survey base map showing the !oc [ion of the
structures to meet the building permit requirement.
Building permits were delayed due to the need to provide upgraded azchitec drawings
for temporary swctures; and later, for permanent tie downs. The locations shown to
survey accuracy on the included maps. We will provide labels on the County ps to more
cleazly name and identify the structures if that is a remaining concern. ou will be
provided with copies of the approved building permits upon our receipt of the s e.
#6. C. Obtain approval on drainage and erosion control plans. From the co spondence
from Brad Janes and from Lonnie Sheldon in the County Engineering Dep ent, it is
appazent that the operator is working with Engineering on these issues in the eld. It still
appears from Mr. Sheldon's comments that adrainage/erosion control plan is eeded. He
is out of the office this week, but I will be contacting him to clarify this issue d whether
he believes this requirement has been satisfied.
We believe that the memorandum from Lonnie Sheldon attached to your co spondence
was clear that these concerns were satisfied. A drainage control plan was pro ided to the
State under the Storm Water Management Plan, and copied in triplicate to the ounty. We
understand the County's concern for drainage off site and will continue to wo k diligently
with Engineering accordingly. It should be remembered that there are two St to agencies
that oversight drainage and erosion control over the mine property, both byre lation and
respective permits.
#9. Technical review of mining~lan for South Quarry. Prior to any work in this area, a
mining plan must be submitted for technical review to address such issues s drainage,
erosion, traffic/access, and health-[elated issues. Your plans indicate that a tazgeted
extraction areas include portions of the South Quany (I4, I5, J5, J6, J7, KS) Please be
sure to submit appropriate plans for review prior to beginning any work in the a areas. In
order to allow adequate time for review, it will be helpful for you to submit an such plans
at least 6 weeks before you plan to begin work in any of those areas.
Tuesday 17 November 1998 Correspondence in the matter of Special Review File 97-ZR096u, Rocky
Road Quarry, [o Carol Evans, Latimer County Planning Depanment, from Douglas J. Bachli Vice-
President, Rocky Road Investment, Inc.
