,_ _; <br /> <br />Mr. Thames Hartley -2- June 25. 1995 <br />the Division cannot locate a source of legal right to enter the <br />Golden Crown claim. There may be others, but hopefully the <br />ownership/legal right to enter table that COM, Inc. has agreed to <br />prepare will resolve this issue. <br />As a further point of clarification, you have indicated in your <br />letter submitted June 22, 1995 that the graded rock and topsoil <br />stockpile locations had been moved off the Time Lode Claim, and that <br />the area had been excluded from the permit boundary. Did you mean <br />to say Lillie of the West Claim rather than Time Lode Claim? <br />If, as it appears will be the case, legal right to enter issues <br />modify the configuration of the permit area, new maps and acreage <br />figures will have to be provided. <br />Mark Steen, of Mi Vida Enterprises, indicated during the hearing on <br />June 22, 1995 that the mine dumps located below the ramp to the <br />coarse ore bin are a potential source of ore for Mi Vida, and as <br />such should not be used as a borrow source for embankment fill. <br />Please commit to resolving this matter, and providing the Division <br />with documentation of the resolution prior to using these dumps as <br />a borrow source. <br />2. In item no. 4 of your June 22, 1995 submittal, it is proposed that <br />tailing pond water management prior to construction of the permanent <br />dam raise would consist of finalizing the temporary 2 foot high berm <br />on the dam crest, and continuing use of the decant system for <br />dissipation of storm water inflows to the pond with storage of the <br />storm water decanted from the pond to be behind a repaired bulkhead <br />in the Hazel-A adit. This interim (pre-dam raise) water management <br />plan is acceptable to the Division as long as the following items <br />are addressed: <br />a) Only small amounts of water will be stored in the Hazel-A adit <br />except following storm events. A functioning system will be in <br />place to allow Hazel-A water to be pumped back to the pond to <br />utilize evaporative dissipation as needed. <br />b) All tailing will be removed from the Hazel-A as required in the <br />Division's 6/7/95 inspection report. <br />c) A complete description of the construction and caulking of the <br />Hazel-A bulkhead will be provided. The Hazel-A bulkhead will be <br />repaired and water tight no later than July 12, 1995. <br />d) You stated at the June 22, 1995 hearing that the Hazel-A <br />bulkhead was leaking because it had been sabotaged. To prevent any <br />future incidents, and because it is a requirement of the reclamation <br />plan, the Division will require that a locking gate or other portal <br />entry safeguard be installed at the Hazel-A this summer. <br />
