Box 17304 <br />Boulder, CO 80308-0304 <br />RE: Adequacy of the Application, Gold Hill Mill, File No. M-94-117 <br />Dear Mr. Hartley: <br />The Division has received your adequacy responses dated June 21, 1995. <br />The following adequacy concerns remain to be addressed. <br />1. In your letter dated June 21, 1995, you have agreed to provide the <br />Division with a table listing each claim to be included within the <br />permit boundary, with the name of the owner of each claim, and <br />specification of the mechanism by which COM, Inc. has been provided <br />legal right to enter each claim, along with supporting <br />documentation. By way of a reminder, acceptable supporting <br />documentation is described in the Mineral Rules and Regulations <br />(Rule 6.3.7) as "a copy of access lease, deed, abstract of title or <br />a current tax receipt. A statement by the Landowner and <br />acknowledged by a Notary Public stating that the Operator/Applicant <br />has legal right to enter and mine is also acceptable". <br />You have previously submitted information, apparently from the <br />Boulder County Tax Assessor's office, demonstrating that either COM, <br />Inc. or Mi Vida own or control most of the claims included within <br />the permit boundaries proposed and depicted on the maps submitted <br />June 22, 1995. The milling contract between COM, Inc. and Mi Vida <br />is a sufficient demonstration that COM, Inc. has legal right to <br />enter those claims and mines owned or controlled by Mi Vida and <br />listed in Exhibit C of the milling contract. However, COM, Inc. has <br />not yet demonstrated a legal right to enter certain claims that are <br />included in the proposed permit boundary. As noted in the <br />Division's letter dated June 20, 1995, two such claims are the <br />Lillie of the West and Gold View No. 1. The new maps submitted June <br />22, 1995 appear to continue to include portions of these claims <br />within the permit boundary, and as such legal right to enter these <br />claims must be demonstrated in accordance with the Mineral Rules. <br />In a further review of the application documents submitted to date, <br />
