-~- <br />this stipulation can be removed from the permit by incorporating the wording <br />of the stipulation into an appropriate section of the permit application. <br />STIPULATION N0. 7 <br />A PERFORMANCE BOND IN THE AMOUNT OF 5300,000, PAYABLE TO THE STATE OF <br />COLORADO ..AND THE OFFICE OF SURFACE MINING, MUST BE FILED WITH THE <br />DIVISION BEFORE CONSTRUCTION BEGINS OR WITHIN 30 DAYS OF PERMIT <br />REVISION APPROVAL. <br />This stipulation has been resolved. No update necessary. Performance bond <br />coverage for the Roadside and Cameo mining operation is adequate at the <br />present time. <br />Section IV - Miscellaneous Permit Updates <br />1. The Certificate of Insurance provided as Figure 2.03.9A in Volume I of <br />the application has expired. This certificate must be replaced by a <br />new one which provides adequate personal injury and property damage <br />coverage as specified by Rule 2.03.9. <br />2. Information contained in Section 2.03.4 of the application regarding <br />identification of interests should be reviewed by Powderhorn Coal <br />Company and updated as necessary. <br />3. In order to ensure that information in the Division's files regarding <br />the areal extent of the operation is accurate and up to date, the <br />Division requests that Powderhorn Coal Company provide estimates of <br />current permit area, affected area, disturbed area, federal land area, <br />and private land area acreages comprising the Roadside and Cameo mining <br />operation. This information should reflect the areas affected by the <br />CRDA No. 2 and No. 3 permit revision as well as any changes in acreages <br />resulting from the various technical and minor revisions processed <br />subsequent to permit issuance. <br />Powderhorn Coal Company should continue to comply with Stipulation 2 of <br />the revised (April 8, 1985) Findings Document. <br />Powderhorn Coal Company should submit all alluvial well data as <br />committed to in the company submittal of March 7, 1983. <br />Powderhorn Coal Company should revise the permit application to reduce <br />the intensity of the alluvial well measurements (depth-to-water) from <br />weekly to monthly monitoring. Along with this reduction of monitoring, <br />Powderhorn Loal should commit to quarterly depth-to-water measurements <br />of the three piezometers located on Cameo Refuse Disposal Pile No. 1. <br />This commitment will ensure compliance with Section XVI of the revised <br />(April 8, 1985) findings Document. Furthermore, when Cameo Refuse <br />Disposal Areas 2 and 3 are developed and piezometers are installed, <br />Powderhorn Coal should commit to quarterly depth-to-water measurements <br />at each piezometer. <br />
