-5- <br />Section III - Status of Stipulations <br />All stipulations attached to the November 4, 1982 findings document for the <br />Roadside and Cameo mining operation were evaluated for compliance during <br />review of Powderhorn Coal Company's permit revision request to add two <br />additional refuse disposal sites to the permitted operation. As part of the <br />approval process for the revision, the November 4, 1982 findings document was <br />modified and re-issued to reflect the addition of the two new disposal sites. <br />Modifications to the original findings document included a comprehensive <br />updating of all stipulations attached to the original permit. Stipulations <br />which had been satisfied by the permittee were removed, ongoing stipulations <br />were retained, and other stipulations associated with the permit revision were <br />added or modified as necessary. The following section details the Status of <br />resolution of each of the 7 stipulations attached to the Cameo Refuse Disposal <br />Area permit revision approval. <br />STIPULATION N0. 1 <br />SIX MONTHS PRIOR TO BACKFILLING THE CAMEO AND NORTH DECLINES, THE <br />PERMI77EE MUST SUBMIT A PLAN FOR DISPOSAL OF COAL PROCESSING WASTE IN <br />THE CAMEO AND NORTH DECLINES TO THE DIVISION FOR APPROVAL. THIS PLAN <br />MUST INCLUDE A DISCUSSION OF THE PROJECTED EFFECTS OF DISPOSAL AND A <br />RECLAMATION PLAN FOR THE DECLINES. <br />This stipulation will not require resolution until the mine nears permanent <br />cessation of operations. As such, the stipulation is considered to be ongoing <br />in nature and will remain attached to the current permit. No update necessary. <br />STIPULATION N0. 2 <br />THE PERMI77EE SHALL SUBMIT TO THE DIVISION AN ANNUAL REPOP,7 OF INFLOWS, <br />DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS REPORT IS TO <br />INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF <br />INFLOWS; A TABLE KEYED TO THE MINE MAP WHICH SHALL CONTAIN THE SOURCE <br />(I. E., FAULTS, FRACTURES, ETC.), QUANTITY, DURATION, AND QUALITY (pH, <br />ELECTRICAL CONDUCTIVITY, AND TEMPERATURE) OF ALL INFLOWS; A TABLE <br />CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUMED IN THE <br />MINE AND IMPORTED FOR USE WITHIN THE MINE; AND A DISCUSSION OF THE <br />WATER BALANCE IN THE MINE. <br />This stipulation is also considered to be ongoing in nature and thus will <br />remain attached to the current permit. No update necessary. <br />STIPULATION N0. 3 <br />THE PERMI77EE WILL COMMIT TO THE UTILIZATION OF THE <br />GREASEWOOD/SHAD SCALE, SHAD SCALE, AND GREASEWOOD REFERENCE AREAS FOR <br />DETERMINATION OF REVEGETATION SUCCESS ON THE CAMEO NOS. 2 AND 3 REFUSE <br />PILES WITHIN 30 DAYS OF PERMIT REVISION APPROVAL. <br />
